OP glad you are ok. I hate to say it but do not trust anyone on the road, nor give the benefit of the doubt. Honest people will lie as easily as crooks to avoid trouble. Hope you get it sorted and taken care of.

Ok well My cousin is a constable talked to him gave him the guys info the guy called me around noon today and offered me 800 bucks. I don't need the money and I don't want more then the damage is worth so I told him ok I can find a new tail and subframe for that. It was kind of like an oh moment when it happen cause I've never been hit by a car. I talk to the guy and asked him why he didn't have insurance and he said "man insurance is to high" but he just coughed up 800 that's like a year or twos worth of insurance.

I have a cage and sub cage on my bike so no fairings got damage when the bike fell over.

Well then that. If I get hit on a motorcycle I'm injured and my bike is totaled.

1)Yes, you should have called Police
2)It would be nice to settle out of his pocket; however, there are NO charges can be made on him.
3) Go to a station now and file a report
4) Let your insurance know about the accident
5) call him up and ask him to pay for the damages out of pocket and see what he will say
6) if he refused to pay, take the case number from police and file a civil matter lawsuit against him. I can alarmist guaranteed you that you will WIN.

I've seen people transported for a 5 mph (car vs car) bump in a parking lot.

Truly, it's simply a matter of playing by the rules. Obviously, If you aren't hurt, then you don't need the ambulance. "I'm okay, officer. I was just a bit wound up after being hit." Goes a long way.
You DO need PD to respond. You're more likely to see a resolution with the officer on scene (vs filing paperwork after the fact).

Thankfully, you weren't seriously injured and the bike is repairable. Glad you're ok.
