No charges filed at this time? Really? He should have at least been ticketed for failure to yield ROW on the spot.

I love how it states Texas law says you have to come to a complete stop at a stop sign. NO . Last time I looked in the dictionary STOP and stop were synonymous.

Im looking at this accident trying to figure out what the rider could have done different. Only thing I could think would have been to hang back farther to maybe be more visible which would also allow for a little more stopping distance. Not placing any blame or like that just going over the incident in my head based on what was published to try and avoid this happening to me.

JC The Lawyer, I am not that smart so could you elaborate on why and what charges could or should be brought and why. I assume you mean criminal charges, looks like a slam dunk wrongful death case which is civil.(no sarcasm there, genuine inquiry and desire to learn). As I read it and see it if the motorcycle was following at a certain distance or lane position to the preceding vehicle or the black color did not stand out against the vehicle trailing, it could have been genuinely obscured. If the lead vehicle is signaling, slows and begins to make it right, and the pick up only sees the lead and trail vehicles and not the bike in between, and pulls out to make what he deemed to be a safe left turn, how is it more than anything but a tragic accident. Doesn't appear to be any excessive speeds involved and I didn't see where they stated whether the rider was wearing a helmet or not. They usually do when we don't, so one might assume he was. It just happened to have occurred at an intersection where there have been issues with people running that stop sign. The report indicated the truck was stopped for heavy traffic. So I am confused help me understand.

Like Rowdy76 said I'm not looking to place blame, I just want to know how to keep it from happening to me or anyone else if I can. In heavy traffic I tend to take the outside positions in my lane and not the center. My reason being I feel it gives me a better view of what's ahead, gives other drivers a better chance to see that I am not a whole in the line they can swing into, and it gives me more room to maneuver and or stop laterally in the lane.

As for the Rider, our prayers and condolences to your family bro.
