Hate to say it but the judge was partially right here. If the Officer's did not/could not serve a search warrant then they were unlawfully on his territory. We have the right to defend against unlawful searches and seisures as directed by the 4th Amendment. The question is, if they were serving the wife civil papers, why couldn't they get a warrant?

, that is some crazy ruling... we have a right to resist? , the next time I get pulled over, I am going to try that... I am just going to roll up my windows and lock the doors... i want to see what the cop is gonna say....














next thing you know, my is getting beat by the police.... (like in the Chris Rock skit, "how not to get your kicked by the pOlice...)

they were serving the dude....she wouldnt go get him, so they thought they'd play the "I'll take you to jail 'cause you're not helping me and I'm a bad " routine....that's when the got nasty.

and they couldnt get a search warrant....they had no reason to search...it was civil papers they were serving him with.

I think you were being facetious but you should 1) Read the 4th 2) Make sure you don't do something foolish like assault a cop when you get pulled over...you'd be the new Rodney King 3) If you're in the car the will remove and taser you in most cases like that lady up north a few months ago

HAHA you're probably right-many would be tempted to hand down the beating. Though if they've pulled you over they most likely already have probably cause and can search etc. The other difference is you are operating a car on a public roadway instead of the familiy's situation where it occurred at their home.

nice to see the justice department realizes that cops aren't above the law.

Had the officers choosen to let it escalte to the level of deadly force, the homeowner would have been justified and legal had he shot them dead.
They might be sworn police officers, but when they entered the premises without a warrant, they broke the law. At that point they became corrput, criminal, peace officers.
