Got an issue. Need some advice.

Hello motohouston-

I've run into quite a pickle this weekend. I purchased a 94 Ninja zx7 from a dealer (I think). He told me that the only issue wrong with it was that the carborater was nasty due to it setting for 7 months. Now less than 24 hours after me having it and on the first test ride after me owning it.. the bike throws a rod. Talk about heated. I finally get the chance to afford a bike and it's useless 24 hours later. Anyhow, i need some advice on how to approach the situation as far as my rights (lemon law) or anything else i might be missing. Thanks.

I've sent an email and tried to call. The thing about it is... when i got home and started looking over the paperwork (title and all) it shows the previous owner being an individual and not that dealship that i bought it from. I am still waiting on a response from him to see if he is going to attempt to correct it or if he is going to try to play hardball with me. Something about the whole thing seems quite fishy.

If you got it from a dealer you might fall under the 3 day law that enables you to take it back and cancel the deal. Worth checking in to.

It's probably a spun bearing more than a thrown rod because these motors are bulletproof. I am on my second motor as well though as I beat the loving out of my last one. If you can't return (lemon law prolly don't apply as it is a 94 and probably sold "as-is") it to the dealer, please PM me with your asking price. I'm looking for a track bike in addition to my zx7 as a street bike and I love the way this bike rides. If nothing else, maybe we could trade + a lil cash for your plastics if they are in great shape.

I would go back to the dealership and calmly explain the situation and see what they do about it.
2 possible scenarios are they refund your money or replace the engine.
Another is that they may tell you to go pound sand.

What was the premise that the bike was bought under if it wasn't running from sitting up for 7 months? Was the bike sold As-Is, No Warranty?

Did the engine hydrolock because the float was sticking open and filled the cylinder with fuel? If so that could break a rod.

The bike ran (roughly) at rpms less than 2500 so in order to get it home... he suggested stay on open roads and go directly home and start clean the carbs (which i did). Now on the first test ride after cleaning the carbs, i heard a tapping at speeds around 0-45... 55 the tapping got quiter but more rapid so i turn the bike around and headed straight back to the house. Didn't make it though and had to be picked up.

I am not familiar with the details of it. You might want to go up there and talk with him and see what he has to tell you. Do some internet research on the 3 day law. I used this law once at a used car dealer, he wasn't happy but he took the vehicle back. good luck

I did... as you can see from the email... However.. i'm not made of money and if i'm going to have to spend another grand to fix it i might as well have bought a different bike from him.

And he was good to work with and i don't think he did it intentionally but comon.. how would you feel if you bought your first bike and and it broke down 24 hours later. Guess you live and learn.

there is a three day law of some sort, but it doesn't really apply to motor vehicles.

Right, it really doesn't apply to used vehicles sold "As Is / No Warranty".
