dicovered bike really has 22,900mi WTF

Ok, so I just bought this bike off of craigslist from some dude in Tomball. I checked it out, and everything looked great. It's a gray&black 2002 Yamaha R1 ODO=5300. I personally like the torque of this bike. Anyway, I quickly found out that the bike has some sort of issue. It's spitting out coolant from the resevoir when the bike gets hot and you get on it. I have absolutley not issues when I ride regularly, but when I'm on it hard, it starts to overheat, and I notice I have to refill the coolant. Also, I have had to fill up the oil but it was only 1/2 a quart after 1000+ miles, which the dealership said was typical. There is no water in the oil, and nothing vise versa. Almost like it just... boils off....

Anyway, it gets thicker. I went up to yamaha off of 1960 and requested the service records for the bike. When I got them, it read 22,900 MILES!!!!!!!! It now has 5,300 !?!

I immediatly called the dude, and he said that it has a new crankcase and everything in the motor is new. He had also said that he never had and problems but the service history clearly shows that someone had attempted to rebuild the motor and put it together wrong, for example: valvue timing, motor mounts switched, etc etc. And it also has recommendations that he like an engine breater hose, and air filter.

The guy says that he sold the bike AS IS, and that I can't have my money back. Grant it, the bike is beautiful, and I wouldnt want my money back, but is there something wrong with the fact that the bike had 22,900 miles no longer than 3 months ago, and now it has 5,300???? I know it's illegal to change the mileage, but is it illegal to switch out the crankcase, and internals and start mileage over?

Please let me know, because if I cant sue his , I'm at least going to knock a tooth out.

it depends what he stated on the title or not...."actual mileage" and if he wrote 5300....then it is illegal to put actual mileage.

SUE!!!!!!!!

dont even warn him. just take it to court and let his first warning be the notice to appear. if he tries to "all the sudden" want to work it out. ignore him. tell his to save it for court day.

You should let him know that your gonna take it to court and see what his rection is. Maybe he will refund you some of the money and let you keep it. Then fix that piece

you dont need a pending assault charge if your taking someone to court. what i would do is estimate what you think is FAIR that he owes you. i would be as honest with yourself in coming up with this number, and sue him for that amount. stay as rational as possible in court, and just state the facts. you didnt do anything wrong, he did. so most likely the judge will decide in your favor.

you might even take the bike and have an estimate done. its ok if the estimate is way over what you think is fair. your just trying to show the bike needs alot of $ worth of work. if you are being FAIR in asking for a reasonable amount, it'll do wonders for your credibility in the courtroom.

Did you ask about the maintenance and service history before you bought the bike? This is typical of buying a used bike. Verify everything that the seller tells you or go into it with the mindset that anything and everything can go wrong. "AS - IS" is simply that. Texas lemon law doesn't apply to private party sales IIRC.

You're pretty much hosed unfortunately.
You could take him to small claims court, and you might win but then you still have to collect from him. Not an easy task.

From your description it sounds as though you have 2 issues;
1) It sounds like you have a partially blown head gasket between the water jacket and the combustion chamber, the coolant is probaly just going out the exhaust.

2) It is NOT normal for that bike to use that much oil in that short of time. Could be excessive cylinder wall to piston clearnace or worn vavle stem seals / guides.

Find out if the service performed by Yamaha has any connection to the problems you have now and if they are still under warranty.

I would take him to small claims court, I have a good friend who does these cases for a living and doesnt charge much. But if he wrote actual mileage on the title, and you sue him you need to decide what you are suing him for? Repair costs? Money back? Also understand this could take a long time and cost you more money in the long run if you dont win.

I understand your pain, I had a member of this site, who actually is a really nice guy despite the fact the he sold me a "99 bike" but was really a 99 frame, 98 and 97 miscllaneous parts, and a 97 engine. When I confronted him about it he said he would ask the previous owner who was a friend of his, but then never got back to me. Not that big of a deal but cost alot of my time going back and forth to get parts thinking it was 99 and finding out some were 97, 98 and 99! But I got a really good deal so never gave him too much about it. Just goes to show you better run the vin #'s on both the frame and the motor and get the service history on all used vehicles before you buy them! Otherwise its mainly your fault, especially if all you have is a Bill of sale and not a title.

So lesson learned.
