Driver may have been ticketed, but unless he was DUI, driving recklessly, or the crash was intentional there's probably no criminal charge that can be filed.

He could still face a civil lawsuit

Most likely he won't be charged. It's strange because they increased the penalty for accidents resulting in injury or death from a failure to give the right of way (i.e. left hand turn in front of someone). You can now get up to a year in jail for it. They never seem to use it though.

The below comment was posted on that story. me off this morning reading it. Way to paint every rider with the same brush, say facts are missing, then go ahead and point fault at the biker.

"It never said he failed to yield, the story lacks critical details that would better answer this question. People who who ride motor cycles typically see themselves on seperate level than vehicles, they tend to speed and make dangerous risky maneuver because they're on a bike and feel invincible with 1) no helmet / pants / jacket / gear & 2) the girl friend who piggy backs along eho they need to show off to. If it was a pizza driver, I'm sure he was in a neighborhood and for someone to die in a crash then they must have been well over the speed limit. The motorcyclist is at fault, the pizza driver was just driving like everyone else with common sense does"

As much as I'd like to get upset about this gross generalization, I must admit it is not entirely baseless either. This person's descriptions are not too far off what a lot of riders here on MH either boast about themselves or complained about other riders they witnessed. The only difference is that it's spoken by a car driver.
