I used to live right next door to Tony Polumbo. I even house sat for him a couple times when he was on vacation -- then once I got pulled by a constable for display of acceleration and got scheduled in his court. I figured I was gonna get off easy but he hit me for all the standerd fines and fees. He's a hard-, so it's good if you've got him on your side.

sounds sadly like the experience I had with AJ Foyt here in Houston.....they lost my business on an '06 GSXR750 because they wouldn't come off another $60 to cover the difference in cost of the jacket I wanted vs. the helmet they were going to give me when they figured out they didn't have the helmet in my size. The manager came out to talk to me and said "give me $60 more and we've got a deal" I said "I'm walking if you don't eat the difference on the jacket vs. the helmet" he said "better get to walkin"......I walked out and went and bought an '07 GSXR750 at another dealer that afternoon and got a better deal on the '07 than AJF was giving me on the '06......

the judge has to hear BOTH sides of the issue before making a decision - he can't just take your word for it otherwise how does he know you are telling all of the details?

Are you sure he didn't just send them a letter saying a claim has been filed and to come into court to discuss?

Be careful about slandering a dealership - their lawyers won't like that, especially if the deal is a deal.

1. This wouldn't be slander but rather libel. If it were proved to be so.
2. Slander or libel would be very hard to prove in this case.
3. You have to prove that his statements are untrue and were malicously delivered. In order to get any real compensation for said damages. So I believe the attorneys can chill.

this is true. slander is stating something publicly that is not true and hurting the defending party. in this case its true and the originator of the post is practicing his first amendment.

MH wont be liable in either case.

Though I've never purchased a bike from Tejas, I do business with them often. The service, parts and accessorie peeps have always been very friendly in comparison to most local shops. Just a few weeks ago here on motohouston they rated pretty high when peeps voted on their fav shops. So I hope this isn't so! But good luck to you Ghostrider.

The one thing you will learn about cash (which you obviously have not yet) is that you also have to work hard to keep it. That means protecting yourself. Had you paid with a check you could have walked to the bank and put a stop on it like another poster wrote.

Oh yeah, don't ever walk into a place with cash expecting to walk out with the merchandise that day. If you do, you'll get buyer anxiety and cut yourself off at the knees. Be ready, able, and willing to go home empty handed and try again tomorrow/elsewhere if you want a good deal. A good salesman can see your anxiety and most will take advantage of it even if they are otherwise decent salesmen. Flash the cash and show your serious, but remain cool.
