must read, texas flee law

WTF? We have a law current in texas that you must try to flee the house if there is an intruder before you use deadly force. I hope this new law passes. http://www.dallasnews.com/sharedcont...e.3abaea7.html

you kidding me!? that's what makes Texas so great, you can plea self defense. J/K and if he was try'n to break in, maybe not death, but he at least deserves a battle wound to make him think about it the next time. And how are they going to know that you tried to flee the house??? There's not a snow flakes chance in that law will get passed.

You don't understand. That is the current law. You have to prove you tried to flee before you shoot. The new law trying to be passed is you won't have to prove you tried to flee. you can shoot if someone is in your house, your car or your place of business.

this new law shouldnt even have to be mentioned, it should be a given that if you break into my home, your gonna get some horizontal ventilation.

another good thing bout the law is that he states that ur car or in our cases motorcycles are an extension of our "castles".....so that means if it gets passed then we can shoot the thief if we catch them trying to steal our bike or car?

When I took my CHL, there was nothing mentioned of that old law...

...it also would seem to conflict with other, ie use of force and lethal force in defense of ones property after dusk/sundown for example. It does serve as a good example of how cluttered our 'laws' are.

I've never heard of it either, first time for me. I wouldn't worry about it too much. If you are in fear of your life or threat of serious bodily injury you have just grounds to defends yourself. When it comes to any defensive shooting situation, you must be able to clearly articulate why you did what you did. As long as these bases are covered you have nothing to worry about.

I don't know of any grand jury in Tx that would indict a homeowner for justifiably defending their family and property.

Ha yea have heard of that one a few times. :BangHead: I am sorry but I dont know any jury in there right mind that is going to say she is going to have to pay the family of the guy that she thought came in her house to try to rape her,she was scared that person was going to do something to her 6 year old son. So she shot them to protect her and her son.

The gun magazine I get had a good article last month about the laws in Texas for using deadly force and CHL.

It all comes down to what's "reasonable". If a reasonble person would have retreated then the use of deadly force is not "ok". Oh yeah and you can't use deadly force to protect your "property" (i.e. car, bike, truck, etc.) only your person or your family and again if a reasonable person would retreat you must retreat before using deadly force. That includes if not especially CHL folks.

Sometimes I wish we could be back in the 'old west' where you can shoot first and ask later....LOL.
