I wonder if the jackass in the Altima is able to buy another car if his current one catches fire?

That's a good sign as long as he follows through. DOCUMENT EVERYTHING.

yeah...i know. but i'm lucky to even be getting a dime out of this. being back on a bike is more important to me than making him suffer.

True... but part of the point is that the NEXT guy may NOT get back onto a bike.

Think he checked if you were wearing gear? Nope. Might as well have been a squid and not survived as far as this guy is concerned.

it's our own responsibility to take care of our selves. the idiot is the constant, not the variable.

Except that his actions were entirely deliberate. Now that he's faced with consequences, he's trying to make amends, but he and drivers like him are far more common than we like to admit sometimes. I've had more than one cage deliberately move into my lane despite knowing I was there, been cut off by cars that weren't speeding until I passed them and tried to change lanes (legally, with my indicator going), when I wrecked the first time, it was a cage that swerved into my lane and brake checked me.

Don't get me wrong, it's a nice gesture that he's willing to pay for your bike repairs but, once that's done, he's right back on the road, free of consequence and only a dent to show that he almost killed someone just for being on two wheels. Take it to court, please. At the very least, you'll be keeping one maniac off the streets for all our benefit.

trust me i haven't ruled out legal action. if we can't come to terms out of court then it will get ugly.

How did you find out he doesn't carry insurance? Some people hide their insurance card just so they can try to weasel out of it. I wouldn't trust a word this guy says.

I don't think the guy having to cough up four figures in repair bills for the OP's bike constitutes 'free of consequences'.

I'm on your side, generally; I think he should be charged with aggravated assault and jacked up by the D.A. - in addition to having to pay for the damages he caused. But if the legal system isn't stepping up, I can understand the OP going for the highest payoff/least cost & hassle balance available.
