A retailer may without prior advertising give one free or complimentary alcoholic
beverage to an individual consumer in celebration of birthdays, anniversaries or similar
events.
A retailer may offer one free alcoholic beverage to any identifiable segment of the
population during the course of one business day.

I guess you're not getting the part where is not complimentary Mimosas. I pay for one that is so big it can't be served in one single glass, so I have to keep going back so they can pour the rest of what they owe me...duh

By definition one drink is a set amount per type.

Wine = ..
Beer = ...
Distilled beverages = ....

I really don't want to look up the exact amounts but in finding the aforementioned statute, I ran into it. It is based on an amount in regard to taxable income, so it is linked with the comptroller.

Possibly legal then. If no licence = no tax = no sales.

Although I will say by them charging cover they are opening themselves to a real can of worms.

From what I understand this is the only legal way to "give away" beer and wine. As far as the cover charge is concerned they can always say they are charging for a sporting event viewing or something. As far as serving alcohol past 2 a.m., that is a big no no. Zach Truesdell is one of our clients and owns MZM Nightlife, aka Richs and we handle Dram Shop cases for him all the time. Keeps us pretty busy!
