That sucks man, sorry to hear. Yeah definitely make sure the insurance pays out in full. Hopefully you're out of the hospital sooner than a month. Get better man.

All he has to do is file a claim with her insurance company. This is a no brainer especially since it's an injury accident and the police filed a report. If for some unusual circumstance the insurance company fails to pay in full, including pain and suffering, then you hire a lawyer

See what they (insurance) offer. I'd say at least half of the actual damages (hospital bills, future medical bills related to accident, bike repair or replacement, lost wages)

Even a lawyer is only going to recover what's reasonable, then he gets paid from part of your settlement.

It is 35mph but at 35 someone will run up your . Everyone typically goes about 40-45 on that stretch of Braeswood. Good luck and remember a lawyer takes 40% of your settlement. For something like this it may be better to just pay them at an hourly rate up front.

Glad to hear you are mostly okay. Bet that cut hurts like .

Compensation has two components: loss wages and pain-n-suffering. If you have not done so already, start figuring out what your time is worth. Don't forget to figure paid time off, benefits, etc. into your equation. P-n-S is typically a multiple of the medical expenses. A case like this you need a pro to make sure you are compensated fairly. Let me know if you need a referral to an attorney.

If you have not done so already, DOCUMENT EVERYTHING you can think of - date/time/content of every phone call, every conversation, name and title of every person you spoke with, time off work/school, days spent in hospital or convalesce at home. When dealing with the other driver's insurance co, do not offer more info than what was asked. If they ask about your injuries, do not offer even an opinion. Just say you will refer to the doctors for assessment.

update i had second surgery yesterday will be having 3 sunday im slowly moving it around but still in a lot of pain.

Sorry that happened man! If you do happen to hire an attorney along with your pain and suffering, include loss of consortium. This pretty much amounts to the fact that you cannot perfom your sexual duties as a spouse due to your injuries! From the sound of your injuries, if probably going to be very difficult to perfrom without significant pain and discomfort. Your spouse, if you have one is intitled to this loss as part of your damages. Also include future medical if any of these injuries lead to future medical complications such as arthritus or other loss of mobility. People often over-look the value of being intimate with their spouses until they are unable to do so! Good luck man!
