back in december i got rear ended in my car not much damage but bumper paint all scratched and a cut

resulted guy was uninsured

am i lost or i can get him to pay me?? any advice appreciated

The same exact thing happened to me!!!
I got all his information

phone number
license
address
license plate

I went and got a quote from honda

I sent him a letter with a copy of all the documentation I had, the form you fill out (drivers accident report SP-2), the quote, the pictures I took, a map showing where the accident happened, blah blah blah. I made sure all his information was at the top of the letter so he would know I had it.
Then, I bluffed.

Yeah, I bluffed. I didn't want to get insurance involved. I threatened him with calling the cops and getting a lawyer if he didn't pay . I didn't get the impression he was very smart, or very legal so I played on that a lot. In then end I got my money. He dragged his feet for a while but I finally had enough and told him he had 7 days to pay me or I'll get my neighbor (HPD) involved. I ws pretty by now so it was easy to sound mad, I was!

In my case, it is true that my neighbor is HPD but you can lie.

In a case of uninsured motorist HPD is supposed to do an accident report. The officer who showed up at the scene of my accident did not. My neighbor was when i told him that part.

You should have gotten a report.

You can try my route or you can tell your insurance company and they can go after him.

Did you call the police?

Do you have uninsured motors insurance on your car?

If you called the cops and you can get a filed a report you can make a claim on your uninsured motorists insurance.

^^^^if not might have to take this to court! Always get all the info and take pics if you can(leave a disposable in the car)

Don't forget camera phones!

I was psycho with documentation! Good luck, HPD is pretty worthless in cases like this.

keep in mind, if he drives without insurance you already know he makes poor decisions. You already know something about him.

I played the nice patient guy for a while, like a month, then I layed into him pretty good.

No swearing or insults, it cannot get personal!!! Just state "facts"!

Same thing happened to me on my bike.. guy was drunk, hit me, wrecked his "stolen" van in the process, beer cans flew everywhere, he took off running on foot. Looked like an illegal.

Small claims court...go ahead and file now and save yourself some time. Also you might want to contact the DPS in Austin and report him for no insurance. That way he cannot renew anything in his name until he has an SR22 and proved that he paid for your damages.
