Wackjum is our resident LAWYER on the forum. He knows the law and has helped many of our members out many many times. When you reply the way you did, only having been a member of our board for 3 months, some are going to take offense.

A cop told you one time and you Googled it.
He does this for a living, huge difference.
Don't get so offended.

But Ulric this about you calling me a little thats taking things to far, I mean nothing I wrote was even remotely pointed in your direction I don't even know who the you are, I may be a little or a dumbass as another member wrote but I have enough decency and couth to atleast wait until I'm eye to eye talking to someone before I pass judgement. So I will unclench as you put it, but you need to practice what you preach.
No, I'm not the newcomer here... You don't walk into a M/C club and expect the members to kowtow to you and hold your hand. We're NOT a M/C club, so..we're being a LOT nicer than they would be...

If you had 'decency and couth', you'd never have gone on the track you did in the first place, but I don't feel like going into the psych aspects that whole thing.... as for 'practice what you preach'. Read what it says above the avatar.

First off Wackjum I did'nt know you were a lawyer, but lawyer or not I was arrogant and rude and I am sorry for that............................Helios, you are right, I am new here and I should have shown more respect, to Wackjum, You, everyone. Helios I apologize.....................Ulric, I did'nt like the comment, but i'm not going to go into that because I realize now in your way you were just trying to let me know where my place is as the new guy and i'm sorry for jumping back at you...................And anyone else on this board that I may have offended or just plain off I apologize.......................Guys and gals I like it here and hope y'all are willing to give me another chance.Once again, I'm sorry to all, thank you for letting me respond, Troy.

With some common what? :-)

It's only 'common' to someone who wears em or spends time around people who do.

Thank you to those who vouched for me. It makes me feel proud to see the positive impact I have had on the board.

I did not take any offense to what was posted. I pop in and out of threads usually and it can be hard for me to follow a thread in detail. I saw the link, I clicked it, and the first words I read were "In some states, reckless driving..."

Some states define reckless driving very explicitly. For example in Virginia, reckless driving is the charge for going over 80 mph or going 20 or above the speed limit. That is not anywhere close to the law in Texas, and since we are in Texas, a discussion of Virginia or any other State's laws is completely irrelevant and at worse, misleading.

There are two statutes that I think are very vague that may have a disproportional impact on this board. They are Reckless Driving and Street Racing.

As TRDVET already posted the statute, you can see it doesn't specify what reckless driving is. Courts and case law have given us a slightly more expanded definition but it still isn't great:

"'Wilful and wanton disregard,' as applied to reckless driving offense, means deliberate and conscious indifference to the safety of others." - Harris v. State, (Tex. App--Houston [1st Dist], 2004).

The street racing statute was amended in 2009 so it is much better now, but it is still very much a judgment call. The racing statute is Texas Transportation Code Sec. 545.420.
