Well, just at first glance from doing some quick research it looks like this is under the umbrella of a new search and seizure law passed in Florida during March that enables state authorities with the most power in the nation.

besides killing myself (or someone else) while on one of my bikes, this would be the worst. for the cops to seize my chit. i'm not the run from the cops and put it t.v. type, but i will open it up just a little if there are several of us and the cop has to decide which one to come get. but now.......... yes sir mr officer sir, i know i was going 120 in a 65. thank you for the ticket sir.

I remember hearing once, the best way to get a bad law removed or changed...is to enforce the snot out of it. <shrug>

I've been readin' up. Seems like you can get your t back if you fight it.

Asset Forfeiture / Property Seizure
... A forfeiture case my be a Federal Court or State Court proceeding. In order to safeguard their rights, the owner or claimant should realize that the police are not merely temporarily holding the property - to the contrary, in most instances they are taking steps to permanently obtain ownership of the property. An asset forfeiture case may, or may not be, associated with a criminal charge. If an owner or claimant prevails, they may be entitled to an award of interest or attorney’s fees in certain circumstances.

I am guessing they have not tried to seize property of someone who can afford a good attorney yet.

It really amazes me that this practice (not law) has lasted this long. They are not obtaining warrants to seize said property = violation of 4th amendment. There is no due process (trial which they are trying to avoid) in keeping said property = violation of 5th amendment.

doesn't matter if its justified........as long as they pick up the bike & no doubt drag their feet for 6 mos while you're paying a daily storage charge, it ends up not being worth it to get it back. That's how they screw you. Just a few years ago some local PD in Louisana was caught doing this. They were randomly impounding A LOT of expensive vehicles without probable cause. Turned out they were all pocketing the money raised from selling them.
