My dad co-signed on my old GSXR and the title was in both our names....but this was also Maine. I had to have him sign off on it before I could trade it in...

Alright so it's up on Craigslist. Can any mods tell me if posting it up on Motohouston would be breaking any rules?

Yea, it's kind of up to the buyer how the vehicle will be titled. If you leave it up to the dealer, they could decide to put the title in the primary's name, the co-signer's name, or both.

If the title is in her name than the lien holder will only release the title to her/send it to her address once the lien is satisfied, unless you have a previous arrangement with the lien holder and it is in writing that they will surrender the title to you once the lien is satisfied.
However if that's the case they should title it in your name.

If you haven't done that already than you can contact the lien holder, and if you can show that she has defaulted on the payments and you are now the one making them than they may release the title in your name, once it's paid.
You'll need to contact the lien holder and explain your situation and see if they're willing to work with you.

If not, once the bike is paid in full and the title is released you can apply for a bonded title.
Keep in mind though, even with a bonded title IF the girl shows up within a certain amount of time with the title she can claim a right to the motorcycle, and if the two of you can't work it out you'll have to go to court to get it resolved.

The first step would be to contact the lien holder and see what they have to say.
Make notes of everyone you speak to including dates and try to get an agreement in writing.
Go about it in the right way and you will legally own the motorcycle and be able to sell it legally.
Try to short cut it and you open yourself and any potential buyer to legal ramifications down the road. My 2 cents.
Good luck.

You do understand that forgery is a state jail felony and in the case of forging a title document it can be a class C felony?
When you're dealing with the wild card of an ex girl friend I'd recommend having your straight to protect both yourself and any potential buyer.

A bonded title will lower the amount you will get when you sell it. You could always part it out.
