not sure if they updated the story since its original post.

"It happened on the South Freeway near Yellowstone on Houston's south side at around 1:30am. An HPD officer spotted the motorcyclist on the feeder road. They say he was running red lights.

The officer signaled to the motorcyclist to pull over, and the rider stopped at a narrow, one-lane entrance ramp. That's when officers say another driver in a pickup truck sideswiped the HPD patrol unit and hit the motorcyclist, who died at the scene. "

RIP.

Speeding - when has a motorcyclist not been accused of speeding?

In any case, fault for his death is on the drunk. Blaming the cyclist for the getting stopped - may as well say he was at fault for getting out of bed that morning.

Quote:
HOUSTON - A drunk driver struck a patrol car and killed a motorcyclist Thursday after an officer pulled over the motorcyclist for speeding in southeast Houston, officials said.

Investigators said the officer saw the motorcyclist speeding through several red lights on Yellowstone Boulevard at 1 a.m. and pulled him over on Highway 288.

"They were trying to indicate and tell the motorcycle to get off the freeway and pull over to the next exit for his safety," said S. Sorge with the Houston Police Department.

While the patrol car and motorcycle were stopped on the shoulder, a drunk driver coming down the on-ramp lost control of his vehicle, sideswiped the patrol car and drove over the motorcyclist, killing him, according to police.

"He died at the scene -- the motorcycle driver. The driver of the Chevy truck was transported to Ben Taub. He has serious injuries and is under investigation," Sorge said.

The pickup truck driver was charged with intoxication manslaughter. Investigators said his blood-alcohol level was twice the legal limit.

The suspect's and victim's names have not yet been released.

RIP rider. traffic infraction or not, he did not deserve to die at the hands of a drunk.

When I get pulled over, I always try to pull into a parking lot or side street. I believe the officer would appreciate my looking out for my safety as well as his/her.

Never, ever stop alongside a busy road for a cop. GET OFF THE HIGHWAY.

Early last year I would see the Friendswood cops with a person stopped alongside the busy 528 road - when there was a driveway within a 100 yards where they could have been stopped safely.

After several calls to the chief of police to complain about it I must say they are doing much better now.

Related question: In a situation such as this, if you don't feel safe pulling over where the cops ask you to (which BTW how the F do they "ask" you to pull over somewhere, they're in a cop car) can you continue until you find a safe spot to pull over? Or will you just get your beat by the cop and arrested if you try to pull over somewhere else?

IMO, if you slow down. turn on your flashers (or signal) or do something to indicate you acknowledge him, you can goto a "safe" spot.

i've done that and had no prob.

I would slow down and somehow signal the cop (left hand straight up, 90 degree bend in elbow) to let him know that you're aware that he wants to pull you over, stay to the right and stop at the first spot you deem to be safe

In my car, I've always put my hazzards on and slowed down so they know that I acknowledge them, and I've never had any issue with driving a little further until finding a spot that seems a little safer.

I never got pulled over when I had a bike, but it didn't have hazzard lights, so if I were to get lit up, I probably would have slowed down and given a wave or something to indicate I knew he was there, and proceeded to the nearest "safe spot".

Charges are pending against a suspect arrested in a fatal traffic accident at 7000 State Highway 288 about 12:45 a.m. today (May 24).

The suspect, Monson Durham (b/m, DOB: 8-5-68), faces a charge of intoxication manslaughter in the death of a motorcyclist, Troy Allen Randle, 45, of Anahuac. A photo of suspect Durham is not available at this time.

HPD Vehicular Crimes Division Sergeant S. Sorge and Senior Police Officer R. Bymaster reported:

HPD officers initiated a traffic stop on a Kawasaki motorcycle (operated by the victim) on the southbound freeway entrance ramp from Yellowstone. The officers drove along side the motorcycle to inform the operator to move off the ramp to a safer location, the next exit ahead on the freeway. It was then that a Chevrolet Z71 truck drove up from behind, sideswiped the officers' patrol vehicle and then struck the motorcycle. The impact ejected the driver (Durham) of the truck and killed the motorcyclist. The injured driver was transported to Ben Taub General Hospital with head injuries. The officers were not injured.

Tests revealed Durham was over the legal limit of intoxication and charges against him are forthcoming.
