First ticket ever... questions..

So i got pulled over for the first time tonight in sugar land, was rolling with traffic which was doing about 75ish, i accelerated to get around them and next thing i knew the good red and blue lights were in my mirror.
Cop "clocked" me at 90 in a 65, now i am curious to as if i can take defensive driving or not since it's exactly 25mph over the speed limit, i am 19 have never been pulled over before in my life until tonight , and he wouldn't even cut me a break . if i can NOT take defensive driving how much will my insurance increase? my dad is the 'main' rider on the insurance card and he has no tickets either, also will this affect my car insurance? any ideas what the judge will say?

what a great way to get home for spring break and hop on the bike. maybe another 4 month break is what i need.

advice
thanks,

No bikes right now. :(

1) You cannot take defensive driving for a ticket of 25 or more miles over the speed limit (Sugarland.... most officers would write a lower ticket as a courtesy for a borderline speed).

2) It will affect all of your insurance rates.

3) Your two choices are either to ask for discretionary defensive driving, or ask for a deferred disposition. You will probably need an attorney because Sugarland municipal generally does not give these options to un-represented people.

oh that really sucks...since it is over 25 miles over speed limit, you are not allowed to take defensive driving class nor deferred...

my suggestion to you is to lawyer up....otherwise it is going to be on your record....lawyer will try to dismiss the ticket or reduce the fine for you...

go to forum sponsor section, email or call PHAN, he should be able to help you out....good luck

so how much is this all going to cost me, i am a broke college student..
if i get a lawyer i can get it off the record?
which then leads to no raising of insurance?
or insurance will still go up?

you're S.O.L. in Sugarland...

in Houston, I asked the prosecuting attorney to lower the speed listed on the ticket to allow me to take Defensive Driving or else I would plead innocent and fight it, they asked the judge, he allowed it I was happy!

IMO... Defensive Driving is better than Deferred Disposition (the probation term can come back to haunt you)

but

in Sugarland, they will want ALL your money!, prepare your wallet and your , thats speed is good for a couple points too, I think.
and yes the INS will want their "cut" for the next three years too...

I would say min. $350 to start

who wrote the ticket!

Yeah I'm interested too since I just got my first ticket in Texas the other day too. 78 in a 60.

Thing that sucks for me is the even though I would otherwise qualify for the driving class thingy I have an out-of-state drivers license (full-time student) so I don't qualify and have to eat it.

For those who have gotten lawyers for speeding tickets that weren't outrageous (like mine) is it really worth the extra money and hassle?

BTW I'm about to turn 25 so not in the same situation as yz117 with age.

Sorry to hear about the ticket.

The first time I ever got pulled over I got clocked doing 95 in a 55, stupid, I know but it is what it is. I went to court and pleaded no contest. The judge was pretty cool and since it was my first offense, he gave me deferred adjudication and defensive driving with a three month probation and took it off my record. I got off pretty easy on that one since I just paid court fees and the defensive driving.

The second time I got pulled over, I got clocked doing 46 over the limit. I honestly thought I was going to jail, but the trooper was pretty cool and calm, but still gave me a ticket. I hired a lawyer and had the court pushed back for about nine months until I finally decided that they werent going to budge and paid the fine. I believe it in the end it all cost around $400. I honestly think I got off easy on that one as well since I wasnt arrested and best of all, my insurance didnt go up, a few months later it actually went down. How that happened I have no clue, but Im not complaining. Regardless, I learned my lesson. No more speeding for me

You are going to spend a lot less by having an attorney. Just hire one - I don't know exactly what they will charge, because of your speed, though.

I have hired Sullo & Sullo for two tickets of 78 in a 60 in city of Houston. Both were dismissed; both times I paid $75.

But I am 38 and haven't had a speeding ticket on my record since November 1994.

Lots of people hire traffic attorneys and get their tickets dismissed or downgraded. 78 in a 60 isn't that horrible; you may pay more because of your age, though, or other factors.

The 90 in a 65, though - you're going to pay.

1. i need a lawyer?
2. have to hope judge lowers it so i can get it off my record ?
[ let me get this straight, i get off record = no insurance raising? that's why u fight it to get off record so insurance rates stay same? ]
3. im looking around 350-600 bucks when its all said and done?

how can i contact PHAN?

think i can get this done this week before i go back to school for finals ?( college is out of state)

This is really a no brainer. You're going to start getting letters in the mail from attournies. Sullo & Sullo particularly. I've used them twice. It works. Just do what they say. I think they only charge $75. That's it. There's another that only charges $50, but I never used them. Listen to these guys. They know what they're doing. Right now my son is using one of them. Basically the identicle situation you are in. He sped up to get into a hole before a construction area and the traffic was already doing 70+. They asured him, as they did me that the chance are extremely slim. The cop can be out writing 4 more tickets in the same amount of time as going to court and more than likely these other people WON'T fight it.
