i say it's the bikers fault. he just kinda drifted in to that lane. no signal...nothing. had he looked in to his mirror and used his signal, that would have not happened.

By the same token, if the car had been doing the speed limit, or speed comparative to traffic nothing would have either. It is possible, he glanced at the mirror, but failed to notice the speed differential of the car in the lane. Though from the video I doubt he did, and question if he was fully awake or sober.


I'm not looking from a 'legal' aspect... rather, from responsible driving.

Driver, the same lack of attention or concious decision to be an .

Swap the car and the bike..and you'd have a rider that would have to be an absolute dipshit to maintain that speed and lane.

Both are at fault, IMO, though I don't believe Texas recognizes partial fault.

My thoughts are this: The Mustang is moving quickly (clearly faster than traffic speed, and probably over the speed limit) and is passing on the right. Though idiots moving slowly in the left lane often mean faster traffic can't pass on the left, passing on the right is still a "poor" behavior. However, they were both being idiots, and hopefully both learned something.

As a note: I'm not trying to say no one should ever speed or pass on the right - with our low speed limits and our dumb traffic, both will happen. Just be careful while doing it.

Not true. Even from a legal stand point, if he had put on his blinker, he was still at fault.

A turn signal being on doesn't grant you the right to go where you want. It just signals your intentions.

ok... so what you are saying is that not having mirrors absolves the rider from responsible riding and it is everyones else job to read his mind and watch out for him.....
