I think you did good, too.

He was not an immediate threat to you- you really did have the upper hand in the situation, from the way you described it.

Further, the cops picked them up, you esentially stopped their terror of your street, even if only for the night.

I live just down the road- we don't keep the garage door openers in the car, but I still need to ensure my code isn't the factory preset, and begin locking the opener at night. I already double lock the door frpm the garage to the house, and the home alarm helps, but you can't be too careful.

Every one is fine B-rider. you'll live kick my at pool again soon. lol.

I comfortable with my decisions.... one of the neighbors thats talks to the popo all the time said they have done a rash of break-ins in the area. As of this after noon they have been linked to 6 in this neighbor hood. plus posession of a controled substance(the older ladies medication that was in her purse when they stole it- hehehe) plus stealing her purse. for all this i'm sure they will be in for a good 7 days. lol jk. they said 5 years easy. but I know that means a year but we'll see.
and yes the house is protected.

I don't think I could shoot someone with a 12 gauge just for robbery, unless my life was in danger. A few shots with a 9mm is more like it.

My house got hit back in November. Truck was hit 3 times last year. I now step out with my pistol every time the dogs bark.

The neighborhood is going downhill. We are looking to move out soon.

Also... for thiefs... castle laws and old horse trader laws in texas allow you to shot a LOT of people stealing your stuff.

Yep... I think I met you a couple off times when the kids were in elementry school a few years back. It has gone down but it's not the worste in the city by any means.

We should see a huge drop in this stuff, at least for a little bit.

yeah I dont like really them guys!!!!! lol JK. We all went to HS together. Kinda weird that we ended up neighbors. thats where my kid goes but he does tennis. Go figure, a mexican that doesn't like to swim

this thread ran through my mind last night as I headed out the door with gun in hand....before I stepped out the door i knew i wasn't gonna shoot unless the thief had a gun/weapon or if he came at me. Does the fact that I spent 5 seconds playing out the potential scenario of what could have happened make it premeditated?

Premeditation or "with malice aforethought" is not Texas law. In Texas there are basically two ways to take a life: murder or manslaughter.

Murder is the intentional taking of life. When you point a gun at somebody and intentionally pull the trigger, you will be committing murder if you hit them and they die.

Manslaughter is the reckless taking of life. Reckless has a specific definition but it is basically committing an act while consciously disregarding whether a substantial risk will occur. For example, celebratory gunfire on New Years. If the bullets end up killing somebody, you committed manslaughter but not murder because you did not intend to kill anybody. There is a subsection of this called intoxicated manslaughter but it is the same principal: Operating a vehicle while impaired is consciously disregarding a substantial risk.

There is also criminally negligent homicide but this is pretty much reserved for child abuse cases where the parent should have done something but did not.


So to answer your question, it doesn't matter that you thought it over before you stepped outside (although it is good you did). Whether you did or didn't, if you ended up pointing your gun at the guy and shooting him, and he died, it would have been murder.

But self-defense is a justification for murder.
