true, but if you get a judgement filed against her I think her wages can be garnished or something like that.

in essence, even if she dosn't have money now, she may in the future.

You cant garnish under the table wages. If she has no insurance he is gonna pay. It happens every day

i ran into something similar with a friend, took her to court, deported her and judge awarded him the car and he sold it to pay for repairs.
