reckless driving.....dammit

:BangHead: ok so here it is, two guys drivin in the woodlands/conroe. they do a couple of short take off, like maybe 4 inches in air wheelies and one guy rolls slow through a stop sign. no one speeded or anything just goin like 35-45 mph. well what they didnt know was they past a off duty trooper who was still in her uniform but in her civilian car. she kept honkin and waivin at them but they thought nothing of it but a cute girl waiving at them (shes short, behind them and with tinted windows) couldnt see her that well......well 20 minutes later at a stop light shes still behind them and a real on duty tropper with sirens on and everything comes from the other direction and cuts them off and pulls them over. she gets out and waits till HE arrests them and HE puts them in HIS car and then she drives them to jail in HIS car and fills out the report cause he does not know what relly happened. and at that they do not read them there rights until after being arrested for 45 minutes and drove to the jail.......charged with reckless driving, spent 24 hours in jail till being able to be bailed out......court in a month, whats should they try to fight the crime with? any ideas? to me there is something that has to be wrong and get it dismissed for? or might be able to wheel and deal for like a ticket or probation

Wrong, you can't reschedule and she will not forget. He has been arrested that means that he has a class b misdeminor(sp?).

Get an attorney and try for them to lower it to speeding, then ask for deferred adj on the speeding. If your record is clean you should be able to do it.

That reading the rights is only for TV. Cops in here correct me if i am wrong.

There is not much you can do but get a lawyer.

yeah man i know its BS, well the points that i may bring up to the judge are that she was off duty in a civilian car with no video,scanner,radar or anything so its her word against mine of what really happened, the pulling over and arresting officer never knew exactly what happened so he does not know for a fact and have reliable evidense of what happened, also i think i might bring up how as soon as she got out she said so you think you dont have to stop for a police officer and how she was at me for shakin my and toyin with her (my boxers were riding up so i stood up and pulled them down till normal and then sat back down). i think she blew it way out of porportion with the whole thing for that simple fact........and im cause i spent 24 hours in the detox tank for a wheelie, i was in there with dwi,assaulter,armed robbers and a guy that beat the out of his wife(and he was in there less time then i was) that is bulls**t all over a wheelie. i might just try to get it down to a class c ticket and probation or try to get it dismissed all together,but if i get jail time.....oh im rippin someones eye lids clean the f*ck off :BangHead:

i hate to say it, in texas, there is no such thing as police officers, they are " peace officers " and as such, they are always on duty. Any texas peace officer can arrest at any time for actions they deem unsafe. And being mirandized is required, pretty much as long as they did it, no matter how long it took them, they did mirandize you.

you can get a lawyer and try to plead down. but your pretty much stuck.

yeah but she didnt arrest us they guy that pulled us over while sittin at the light, he arrested us and put us in his car and then she took us in and booked us and did all that sh*t. i read in the texas penal code that the arresting officer has to take you in and book you.......but in this case he didnt even know what exactly he was arrestin us for exactly, he knew reckless driving but not exactly what we did.

i think Davis only patrols east montgomery county. that midget fembot used to pull me over every chance she got when i used to have my silverado. she actually pulled me over one time for driving with my running lights on and i see cops doing it all the time. she said they're called "parking lights" and sre meant to be used when parked.
