While a bit of an overreaction and would assuredly have landed you in jail, the moment the cop touched the card without permission, he violated about a dozen different laws.

Yeah - it kinda does. No different than if he reached his hand inside the glove box or even the bed of a pickup. He can look all he wants - touching is right the out.

He asked if the camera had been on and I replied no. He then took it out of the case and said "so this should prove that you weren't speeding" and I said " I do not speed and there is no speeding on the card". It took 3 officers to figure out the card comes out. By the way I was handcuffes and in back of the patrol car while this happened.

May I STRONGLY suggest you immediately get off the forum, shut up about this any further, contact your attorney, and prepare to get rich off Harris county.

If it happened as you described, this is federal right here...you were illegally arrested under color of law and had your 4th and 5th amendment rights forcibly violated.

Being in handcuffs in the back of the car doesn't mean someone's arrested just FYI. It was probably more for peace of mind of the officer that he wasn't going to run or do anything stupid.

yeah a motorcycle cop gave me a ticket for going 27 over when i was going 60 in a 55 with traffic and he was coming the other way moving on his bike i don't see how he could of radared me seeing as how he was on his bike but im taking it to court anyway never been pulled over in my life and im not gonna let a cop trying to reach his quota give me one for some b.s

If the officer was worried about piece of mind, maybe he should have not done what he did.

I'm pretty sure once the cuffs go on you're arrested - at the very least, forcibly detained.

The officer's piece of mind takes a very distant second place to the fact that he (the officer) just committed a few pretty serious crimes based on the description.

The donut muncher had exactly zero authority to even TOUCH the camera, let alone confiscate it.

He could have hit you with radar very easily.

I'm going to guess you've never seen just how many switches are on even a non-LEO touring bike. Its pretty easy to operate any of them.

It will be my word against theirs. I'm sure their is a dash cam that has it but their were two agencies on scene. Brookshire and katy. Maybe if they entered what they found against me but there was nothing to enter. On a side note, they also looked thru my texts and said they knew I was headed to meet friends to ride with and what time we were going to meet and ride. I did try to protect my rights which they didn't like.

CALL AN ATTORNEY RIGHT THE NOW AND SHUT THE UP.

There will be at least one dash cam recording and if there was more than one agency involved - that helps as both of them should have been recording. If BOTH have a blank spot at that time, that smells REALLY bad....
