Carefree signs, fine already making noise

CAREFREE - A controversial program to reduce motorcycle noise in Carefree could backfire after new signs went up this week warning bikers to throttle down or face $750 fines.

The signs feature the image of a motorcyclist and the town's 80 decibel maximum noise level.

However, Carefree's noise ordinance allows 85 decibels, about the loudness of a kitchen garbage disposal.

"It's absolutely amazing the stuff they are doing," said Carefree Councilman Bob Coady, who orchestrated the town's original noise ordinance in 2002.

Coady said he doesn't understand how the town can drop the maximum noise level by 5 decibel level without first voting to amend Carefree's noise ordinance.

Carefree Councilman Lloyd Meyer, who heads Carefree's Noise Enforcement Advisory Committee, said the town is still using 85 as the maximum noise level even though the signs say 80.

"Eighty is merely an educational thing," Meyer said. "This is the standard set by the Environmental Protection Agency."

Critics also question how the town increased the fines to $750. Coady said noise violators had been receiving fines of about $50.

Meyer said the town's codes have always allowed for fines of $750.

The signs are part of a program Carefree recently launched that emphasizes education as well as consequences facing recreational bikers who rev up through Carefree on their way to popular biker bars in Cave Creek.

No bypassing Carefree
Bikers must ride through Carefree to get to Cave Creek.

Carefree had expected neighboring Cave Creek to also post the signs, but the town refused with Cave Creek Town Manager Usama Abujbarah calling the signs "discriminatory" because they targeted bikers rather than motorists in general.

Cave Creek also was not in the mood to take on another noise controversy after spinning its wheels the past two years trying to amend its own noise ordinance over a battle between residents and restaurant owners hosting live music shows.

After the Cave Creek Town Council failed to decide an appropriate decibel maximum, Mayor Vincent Francia encouraged the town to just drop the issue because of its "devisiveness."

While Valley bikers generally disdain the consequences part of Carefree's program, they see value in the educational aspects.

Major motorcycle manufacturers like Harley-Davidson, Honda and Suzuki also support Carefree's attempts to reach out to the biker community, urging them to ride responsibly.

Program starts Saturday
The educational portion of Carefree's program kicks off Saturdayat Harold's Cave Creek Corral, 6895 E. Cave Creek Road.

Among other events, riders will have an opportunity to hear "how loud is too loud" through the use of a noise meter to measure the decibel levels of motorcycles.

Several area restaurants are expected to place "tent cards" on dining tables, explaining how the "freedom to ride is at risk" across the nation because of "obnoxiously loud pipes" about to "bring down the law."

Bill Vale, co-owner of Harold's, said he is unconcerned about the controversy and doesn't believe Carefree's program is discriminatory.

"As a business owner in Cave Creek, I think we have to respect what our neighbors are attempting to do," Vale said.

Not all business owners agree. Biker Mark Bradshaw, owner of the Hideaway bar and restaurant, has been critical of Carefree residents building homes along busy roads, then complaining about noise.

"These signs are so discriminatory. I just can't believe they would actually do something like that," Bradshaw said. "It's total selective enforcement."

Scottsdale biker and attorney Craig Simon agrees. He said Carefree is just begging for litigation.

Carefree Mayor Ed Morgan said that, regardless of how the program turns out, the town will spend an additional $250,000 next year to increase traffic enforcement through the Maricopa County Sheriff's Office.

They do the same thing in a small mining town called Jerome, AZ. It is on a prime piece of twisties between Prescott and Sedona on 89A. I used to live out there and the bikers almost have to coast through town with the engine off to comply. They will fine you and I have even heard reports of worse consequences.

These laws are B.S. when they target a specific group.

what about the with the black lincolns with no exhaust what so every.... aww thats me! good time to ask.. scooter can you hear my truck when i come down the street? never though about it but i bet i off the neighbors when i come home at 3am.... oops
