Getting Srewed?

My dad was in a motorcycle accident, he was on a '94 Harley Davidson Sportster. About 23K miles. insurance is saying its totaled. Offering 2k. The list of parts that the adjuster listed were; front pegs, bent handlebar, signals, a bunch a small bullshit. Nothing major. Im trying to help my pops out, i think they trying to screw him. Plus he had parts accessories coverage with a minimum of 3k. You know for all that chrome. Only people that are willing to help please respond, he lost a leg because some cager was rushing home to get her cell ! so dont clown on this thread please, just need a lil help.

The insurance will never give their highest offer the first time. For sure you can get more than 2k. You just have to fight for it and make a strong case. My friend got 1500 more from his insurance when his bike was totaled by arguing that the bike is worth more.

what is the nada value on the bike, without the mods he has receipts for? can he show the price he paid for all the mods that were/are on the bike?

typically, at least when they were trying to decide whether or not to total my bike after an on-track incident, they took 60% of the NADA value, then added on the rider i had for aftermarket parts ($2k back then) and the damage/replacement price was about $200 under that number. i was close...

good luck man... let us know what happens.

Hopefully he has a portfolio on all the mods and upgrades/chrome he put on. This might help in getting more money as stated earlier. Keep us posted. Hope hes doing alright

Problem is the bike is 17 years old. How old are the parts accessories? Insurance company is only going to pay the fair market value for a 17 year old bike.

I dealt with a "not at fault" total loss a few years back. Insurance offered $5400 out of the gate. I did not have receipts for very many of the parts (as many were purchased used on forums and EBay), but I did have lots of pics. When all settled (about an additional 45 days), the final was ~$10,800.

It was painful, but worth the end result. I did this for a relative, as they asked me to negotiate the claim. I had also done much of the work on the bike.

Best of luck to your Father, and I am sorry to hear of his accident and loss.

Never accept the first offer. I had a kid back into my rear bumper when I was living in apartments. Claim adjuster offered $400 for replacement and paint of rear bumper. Since I had a full aftermarket body kit that was discontinued, I got them to pay for a new full kit + paint on the whole car (argued they couldn't match the paint 100% and I would dispute the work till the whole car was painted). $400 initial quote went to $5800.

Like I said, you can't accept the initial offer. Play hardball. Act like you're gonna get to suing.
