If it actually had the badge, then I'd agree. In this case, it didn't have the badge, just an unlit section of the gauge package. No where NEAR the same thing.

If he didn't bother reading the equipment list on the bike and didnt bother paying attention to what was on his bike, then HD certainly is not at fault. Add in the fact that he "had to lay it down" (which you discover if you actually read information on the case) and you realize he didn't know how to ride it in the first place.

Not HD's fault - its ALL the rider's. Plain and simple fact of life.

I once knew a girl who had a car for 3-1/2 years and never realized the dome light had a setting to enable it to be turned on only when she opened the door. She seriously thought she had to reach in and turn on the dome light at night, and then turn it off. Met more than a few people who didn't even know what kind of car they owned. (Its kinda tough to keep a straight face when you're asking a customer who swears he has a Honda Camry or Toyota Accord which one it is, only to discover its really a VW Jetta...)

The average HD bagger owner sadly puts less than 5K miles per year on the bike. Many of them wouldn't know the engine size without looking on the air cleaner...

I wish I could say I'm surprised. I've seen people try to unlock their cars by opening the back door and getting a coat hanger out of the back seat....

If you want to be sympathetic to the company who admittedly saving them self money, on the expense of their customer (and their safety no matter how ignorant they are) it is your choice - and yep CA jury also agrees with you
