Motocop-Texting like a BAUSE!

For the record I too text while riding/driving so Im not here throwing stones. And for all we know he wasnt texting but checking something police related. I dont care, its not against the law. I hate how people/media blows out of proprtion tho. This shouldnt have even been a story.

Woman Says She Saw Officer Texting while Driving

HOUSTON - We have some shocking video to show you: a woman says she caught a Houston Police officer texting while driving.

Many of us are guilty of texting while driving once in a while -- maybe at a red light or a stop sign.

But when you see an officer who may be texting while driving a motorcycle on the highway in the middle of traffic -- now that's not setting a very good example.

“I was coming off 45 and I got onto 59 near the GRB and my son’s dad happened to look over and he said, ‘What is that right there? What is he doing?’ And I look over and he's texting while he’s on a motorcycle driving,” Jennifer Sousa said.

Sousa showed me the video she captured on her cell phone back on Nov. 16 around 1:30 p.m.

She was a passenger in the car and for about a minute and a half, she said she watched an HPD officer texting while driving on a motorcycle.

“You can him look down, plain as day, and you see his hands moving,” she said. “He picked it up and was texting and then set it back down and was still texting while he was driving.”

“I’m guilty of it too, I was just surprised to see a cop on a motorcycle during 1:30 in the afternoon in traffic on 59,” she added.

But she said there is more to why she decided to whip out her phone and start recording.

“The first thing that came to my mind was a friend of mine that got in trouble for texting and I thought, well you know she got in trouble for texting while driving and then I look over and someone that’s supposed to represent doing good stuff, is doing it too.”

That friend is Geri Montgomery of Humble. In March 2008, the then 23-year-old was charged in the death of a man who was killed in a car accident on 45 near FM 2920.

The victim's parents said Montgomery had been texting and driving.

She was convicted and spent 30 days in jail, paid a $10,000 fine and is currently serving 10 years probation.

“There was so much traffic down 59, it was 1:30, so it’s not rush hour but there’s still traffic on 59 other people driving, he could’ve caused an accident just like anyone else could’ve, so if they demonstrate not to do it then why is he doing it,” Sousa said.

We showed this viewer's video to HPD and they say there's nothing they can do unless a complaint is filed against the officer.

Texting while driving is legal in the city of Houston, so the officer wasn't breaking any laws.

HPD said officers frequently look down to their phones or computers for work-related information.

They say it's hard to tell what he was actually doing on the phone at the time, but they acknowledge the officer wasn't using his best judgment and should limit his distractions to avoid accidents.
