I think it's one of those that could go either way if you were passing legally. Similar incident happened to me in my truck once and it was the turning driver's fault. He was going about 10mph and with no blinker turned left; but, he hit me in the bed of my truck rather than me t-boning him. Maybe if the car would have hit you at the back of the bike would have been her fault. Maybe the correct response when in that situation is don't hit the brakes but speed up and try to pass and you might get lucky.

Hope you heal up well. Looks painful.

Insurance stated they are going to decline the Front end repairs on her car. They are waiting for the police report to come in to see if they rule her at fault. I was told to shutup and let them handle it...... Most likely they will rule me at fault.. and even though she turned in front of me with no signal.. I am ok with it either way. This is why I have full coverage. But the bike is going to be totaled. Accourding to my agent today.

I just don't see how you would be at fault here... I'm not saying I disagree with people who say you are, because I don't want to start an e-peen law knowledge battle, I'm just saying I don't understand how. You broke no law, because you were lawfully passing, and from what you've said, it wasn't wreckless, since you weren't even beyond the speed limit. She, however, turned without signaling, and obviously did not shoulder check before making her turn.

If anyone wants to clear up how it is his fault, that'd be nice. Just voicing my opinion...

Agreed. All traffic laws are theoretically designed to protect drivers. If a driver can lawfully turn into your path while you are passing, then the law is flawed. It is her responsibility to signal timely, check that the lane she is crossing is free of traffic from ahead and behind. Bunch of idiots out there don't ever check their six or signal. I'd place 100% of the blame on the other driver. And since she has a suspended license, her insurance could be void, and she should have been ticketed for suspended license and no insurance. Lawyer up, there is a lot of money you are owed right now. And take charge of this situation and don't get screwed, man up to that dumb and make her pay. Lawfully passing should be just that, lawful passing. Otherwise, every POS car can just drive slow and swing a left in front of a passing car for a heap of insurance money.

Oh yeah, forgot to add, ignore racer X

Passing multiple vehicles at one time is a high risk practice that many have died while attempting. You often cannot see the signals of the front vehicles until you are committed and they will not be looking to be passed by someone other than the vehicle immediately behind them and may turn into you. You may also be cut off by one of the non-lead vehicles as they attempt to pass the slow vehicle. Most riders tend to continue to accelerate through the entire pass so speeds can get pretty high, as well. Surprisingly, passing multiple vehicles appears to be legal in TX (at least it is not specifically forbidden). It was not legal where I cam from.

Glad you are OK and have the opportunity to ride again. Not assigning blame, there seems to be multiple contributors. Merely offering reasons to refrain from doing it in the future.

As a parent/grandparent, I like to see young riders have the opportunity to become old riders.

Yeah well lol... I had my hands covered in blood so I couldnt get my phone out to take pics so strangers took them for me lol..... sad I know.

But the ones in the ambulance the Paramedics took


But yeah somehow in my sleep I ripped some stitches out of my arm.... But the arm is still Numb so its only itching like a right now.

Stitches out.. arm looks like death. Literally, infected, on meds for it, cant clean arm with anything but soap in the bath and cant cover it per like 8 dr's. Rash sucks seriously. Legs are healing pretty fast.

About the concussion Went back to the dr they poked and prodded, claimed I had trapped blood under my skin on the top of my head and it basically used Gravity to pull down to my eye... It is cleared up now. I will have my dizzy spells for another 2-3 weeks. They dont expect my arm to be 100% for about 6-9 months.

yeah... joy.
