I still say "failure to maintain lane". For the one or 2 people I've known caught lane splitting, that was the offense. And a solid white line is a "do not cross" anyway.

The charge is failure to pay toll.

Like running a red light, it can be both a civil violation and a criminal violation. If no live person sees it happening but the system takes a picture of your plate, it will be a civil fine-only case.

If anybody sees you running the toll without paying, it can be a criminal violation. This includes HCTRA personnel who would have to come and testify to the facts. An officer does not have to see you commit the crime in order to arrest you. (If that were not the case, very few criminal acts would ever result in a conviction because it is not like murderers kill people right in front of witnesses and police for example.)

"Riding the line" is a method to avoid paying the toll. The officers on the beltway all know this. They probably could charge you with failure to maintain a single lane, but I have never seen it. Riding the line does not have to be specifically illegal and criminalized just like putting items in your pocket from a store is not criminal. It becomes criminal when it is a means to a result like not paying the toll or shoplifting.
