What do you do if your bike is stolen from a local bike shop?

I have a friend to whom I sold an old dirt bike to. He takes it to a shop. The bike is stolen a week or 2 later. So here is the question.
The shop owner says that his insurance covers it..then sometime later the shop owner comes back and says "sorry, I don't have theft insurance. What would you do? I just want some opinions and feedback. My buddy is really upset and now he is without a bike to ride. I think the shop owner is responsible unless you sign a waiver stating that if anything happens he isn't liable.

I know who it is. I know where but just not saying anything at this time. It's a crappy situation. I told my friend he may need to take the owner to small claims court.

whats the name of the shop?

no point in asking random idiots on the internet what is fact and what isnt. you will get all different answers. lawyers give consultations for free on the other hand. call one up, they will tell you where you stand right away.

you might want some recorded proof the bike was left in care of the shop, even if this is a recorded phone call or something. my guess is shop owner cares more about a few bucks than his reputation. i wouldnt be suprised if his insurance covers it but he doesnt want to pay the deductable.

or the dude is shady in general. is it the same guy who owned precision? you can probably find the dirtbike in his garage.

why wouldnt you say the name of the shop? thats messed up. letting your fellow riders take their bikes there to get stolen too. :(

Yea, exactly... what shop is this?!

Inquiring minds need to know... I wouldn't leave my bike anywhere like that... then again I have theft insurance, so oh well.

Because he has friends on MH also. I already got dragged into this once. I posted about this bike some months ago and someone told the shop owner about the post. He called me all bent out of shape about it. Not sure why. He said the police were investigating it. Something didn't add up so I decided to stay out of it.

Here's the deal, MOST reputable shops carry Garage Keepers / Lot Insurance that cover that type of loss, unfortunately some don't.

Even though he didn't if your friend signed a waiver clause on his service agreement when he dropped the bike off he's SOL.
If he did not sign an agreement than he may have a case.

Yeah I asked him about that. I haven't heard back from him. I think he might be SOL..Didn't pay much for the bike When I sold it but still. Just a bad deal..

and was it just the guys bike that was stolen, or others as well? not sure if he can get that info, but i;m sure a lawyer could make use of that too.

I have to agree on the point you should share the name of the shop. He's for a reason, because he knows he's doing something shady/wrong and doesn't want to get caught or have it known. Do innocent people ever have anything to worry about? Nope.
