Wow. Unfuckingbelievable. It will be interesting to see how this plays out. Hope he rots for a while. Or at least has his license revoked and wages garnished for life to pay medical bills and fines...or something. , I don't know.

doesn't suprise me at all. I had a guy go apeshit because he thought I was going to lane split and pass him. I was just chilling in the inside 1/3 of the lane.

I had a guy try to hit me and the wife when I tried to go around him in traffic. It was all backed up and middle of summer, bike was about to over heat and I thought I was going to pass out. I just wanted to get to a shopping center to chill for a few. He stuck his van out and tried to take us out. I parked the bike and went right up to his window. He locked the door and was crapping his pants. . It was a plumbing van. He was all getting on is phone probably calling the cops to say how I was trying to attack him for no reason.

If he would have hit us and hurt my wife, I would have not let it go. I would have gone to jail for something very bad.

I just rode my bike for the 3rd day in a row and this it the 4th ride in over a year cause of how drivers are.

i remember when i was a teen my dad would take to ride with him.. once a guy on a truck tried to hit us because my dad was trying to go around him to get away from traffic. my dad did the same thing parked the bike went to the guy.. the guy open the door and my dad hit him on the head with his helmet... came back to me and was like that what you have to do if any ever tries to hit you... so i guess that what i would have done lol

Interesting that you mention this, because this is something that comes up a lot in conversation.

In Texas murder is first degree, which is 5 to 99 years, unless it is capital murder. Any attempted crime is one degree less, so in the case of murder it would be a 2nd degree and 2 to 20.

Aggravated assault is also a 2nd degree.

In a case like this, it is better to charge him with aggravated assault, which only requires that he knowingly intentionally caused serious bodily injury. If they charge him with attempted murder, they have to show he knowingly intentionally intended to kill the person, a step the jury probably will not be likely to take. Simplifying matters a little bit, if the jury doesn't convict him of attempted murder, double jeopardy will prevent him from being tried for all lesser included offenses, of which aggravated assault is arguably one.

All of this means jack squat in this case because it happened elsewhere. But just saying, this kind of question comes up a lot around me (must be the company I keep).

I started to mention this earlier. I decided it was not worth it at the time.
