holding someone at gun point question..

example:

your asleep and u get woken up by some noise, u look outside and u see someone trying to take ur bike. u run out side with ur gun (on ur property, with CHL legit) and tell them to stay right there. u ask for there wallets to get there ID's in case they try to run.

1. for some strange reason can u be held accountable for robbing them and taking there stuff at gun point even though they were robbing u 1st

or

2. its your property and u can do whatever u want. the cop shouldnt do anything to u


just curious whats teh right answer??

If its your residence the doesnt matter if you have chl or not. You cannot hold anyone ie civillian/citizens arrest physically....its only a verbal thing. You would have to call a cop to come and arrest him or you might be liable for false arrest. Now heres the deal......if someone is robbing you....you should perceive the act as endangering your life and you were in fear of life.You can only use force under that pretense. Theft of someone of substantial value and cannot be readily replace can warrant use of force.

shoot first, ask questions later. JK. You lived in TX and in TX you have the right to defend your property from thieves. If you feel that your life is in danger then you have the right to shoot to kill. Everything has a fine point/line and it comes to proving your innocence. You will go to jail until the whole story is cleared or the court case is final. Hard subject to talk about but when the time is right, everything will make sense.

hum so the point for a CHL is to defend urself, go to jail, dont stop on go and dont recieve $200, jk, so if u shot and wound someone over ur stuff u still got a great chance of going to jail

CHL also doesn't protect from civil suits and RETALIATION from perp's crew and family. The doesn't end after you pop someone for stealing your in dash DVD player.

ok you tell them to come inside that way you do not have to drag them inside (makes it more ok in the eyes of the law if he in your home) then when are if you shoot him make sure hes died (died man dont talk and dont sue)if you cant shoot to kill do not pull your gun you my be shoot by it gun are have some one docter bills to pay

screw that,shoot htem,then shoot two times in the air,pick up two casings from ur shots,tell the cops there was two of them and they shot first,and u shot back and hit one.then tell them the other got away.

The local sheriffs dept told us if we were to shoot someone on our property to drag them to the front door and make sure they are dead. End of story.

Typically if it's someone trying to steal recoverable property you can't just shoot them unless they are attacking you.
Keep in mind, even if it's a justifiable shooting you can still be taken to civil court, either by the perp, or if you killed him, his family.

if they are on your propety stealing your and you shoot them chances are good you are going to go to jail for a while but if you post bond and get a lawyer you will probably not be indited by a grand jury. not in texas anyhow.
