I normally don't like how our society tends to be sue happy, but in this case it could be a good thing. Maybe give the cagers more incentive to watch out for us since they apparently don't give a about our lives.

You don't need a lawyer yet. Only get a lawyer involved if you can't get the insurance company to give you a fair settlement. Just play hardball with them. If they determine it is totaled. Research what it would cost to get the same exact bike on your doorstep with the same accessories, tax, title, license. EVERYTHING. I did this with my Aprilia recently and I got back every single penny I spent on it with no depreciation. Never accept any offer they give you. Once they finally say they won't go any higher after haggling the out of them, you say that in order to accept that settlement you want to keep your bike. Worked once for me and all they can say is no.

The exact same thing happened to me at the end of July. Three broken bones in my left foot. Consider yourself lucky that you got off without any major injuries.

That's ridiculous. Why on earth would you even consider an attorney for something like this. He will take 35% fee on WHOLE settlement or charge you a large fee. You're doing this to save maybe 2-5% an insurance company will underpay you possibly? You really think an attorney making $250 an hour is going to fight with an insurance company to make the quote an extra 50$ higher is going to help you? He just looks at ok how much is 35% of $50.

Contrary to what people think insurance companies are pretty fair. If you think your bike is worth more prove it and they will pay you. GettIng a lawyer is a dumb move. Put you in the poor house with all the other poor people.

A lawyer situation is if you got hit by the CEO of Citibank and he refuses to pay and you're paralyzed. Then get a lawyer. If you got a scratch on your fairing man up and handle it yourself. Calmly.
