Speeding tickets

Got pulled over today in La Marque for doing a whopping 68 in a 65. Officer straight up told me he had a quota to make. Hmmmm do I fight it and possibly lose ( cops word verse mine ) or suck it up and take defensive driving.

That's chickenshit! It's those cops that give a bad name to cops. Easy win, I believe its 10 percent over the speed limit. They due this for room for error in their radar and your speedometer. They should dismiss it.

La Marque? Frag, I ride through there every day and I may or may not ride above your quoted speed. They sit out there about 40% or the time. I usually wave as I put-put by them.

Hey one avenue you may want to look into is faulty equipment. 3 MPH is less than 5% off. Maybe have your speed sensor or speedo "repaired" and show the judge. Now if you admitted the breaking of the law (Don't talk to cops) you are screwed.

Don't waste your time. I tried the faulty speed sensor equipment once and I still got nailed for not maintaining my car. If it's a quote, they will get there money one way or another and TX City/La Marque don't play.

Speeding is a strict liability crime. Faulty equipment would go to you "not intentionally going over the limit," and intent is not an element.

As a matter of fact, going over the speed limit is not an element of the crime of speeding either.

You can always try to fight it. If it really is a quota, then they just want the money, which they still get if you plead not guilty (court costs).

If you plead not guilty and get the case dismissed or an acquittal, there's no court costs.

fight it! I'm about to fight one in Humble 98 in a 65 the cop was cool told me the Judge rides so he'll probably work with me on it. A van cut my exit lane off and when I tapped my break to drop behind him and shoot around the other side there he was sitting there. 1st ticket in 3yrs that's gonna stick

True, but there are lawyer fees... I haven't ever won a moving violation without one. Even so, I've only ever hired an atty once for a speeding ticket, and he won. I haven't had a speeding ticket in 16 years.

from sitting thru all my speeding ticket cases that i fought, i have learned a thing or 2.

in texas, there is this law (forgot what it is called), but...

Going over those speeds is usually illegal. However, the law in Texas says that if you can provide evidence that, given the conditions you were driving in at the time, the speed you were traveling was reasonable or prudent, then you may not have broken the law, even if you were driving above the posted speed limit.

For instance, if you were ticketed for driving 5 miles per hour over the speed limit, but you were able to provide competent evidence that your speed at that time was reasonable or prudent for the conditions you were driving in, your charges could be dropped.

This can backfire on you tho. It is important to remember that when you do go over the posted speed limit, it will be up to you (not the officer) to provide evidence that your speed was reasonable or prudent for the conditions you were driving in. In theory, you can technically drive 95 mph on the freeway in the middle of the night, but only if you can provide evidence that those conditions were reasonable or prudent (good luck in court on that one).
