I'm not saying I get run off the road almost every day, but I see ahead of me or one, two, or three lanes over along side me, drifting across the lane stripe or braking late, changing lanes suddenly without signaling, and exiting at the last second because they are not looking at the road. That happens every day.

But they won't do it, some say, and therefore the state has to do it. But this assumes that the state cares more about an individual than does his family and friends — a very dubious proposition.
How about we make it legal whereas I am allowed to point a handgun at the driver's head if he's texting, as long as my finger is outside the trigger guard. How would that be for persuasion? I mean, I'm not threatening their life more than they are mine, right?

Since this thread is all over the place anywaayyyyy!! How would you like to have a front mounted license plate! Why is there a seat belt law when there are no seat belts on a motorcycle, and furthermore why has Texas abolished the mandatory helmet law around the time the seat belt law was to be enforced (I'm SURE these things have been debated before and some of my facts and dates are probably off but they exist nonetheless) The point is motorcyclists fought for the freedom to not wear a helmet and won (though I would NEVER ride without one, too noisy and too many bugs/rocks, plus I like my brain) Just don't get suckered into someone else belief system or some gov't belief system, we have the right to defend what we believe regardless of what the driver next to us chooses to do on a daily basis! Stiffer penalties for device related accidents for me!

Its real hard to argue with this.

You can thank insurance companies for that one. They would rather you die then pay out high claims keeping you on life support. From there financial standpoint, make them faster and as unsafe as possible. They will charge you higher premiums in hope of paying out less on the claim...

Try riding the speed limit on a two lane road and someone in a truck turning head on into you with no warning. I had an out as the second bike staggered, unfortunately my friend that had no time or warning wasn't so lucky....

Problem is there are situations where you have ZERO out or time to react unless you decided not to ride that day....

I agree. It shouldn't be a crime if I point a handgun at a distracted driver's head.

So by your logic, why stop at just texters? You should point your gun at everyone who has the potential to cause you harm, which would include every driver hurling around in 4000 pound hunks of metal.

Either your arm is going to get real tired or you'll get shot by someone like me for pointing a weapon, it sole purpose is to injure or kill. I'm sure you'll agree there is a difference between participating in an activity that has the potential to harm without direct intent and directly threatening injury with intent because you better have intent if you level a weapon to someones head.

Judge and jury would see the difference.

Uh, driving while not looking at the road is more dangerous than me pointing a handgun at someone's head with my finger outside the trigger guard. It's sarcastic, but it's also the truth

a. if theyre distracted, they wont see it.

b. if you pull a gun on someone, i hope they DO see it and take you out. being distracted and intentionally threatening someones life are two different things. get real.
