^^^ actually probably not, a decent attorney, and you can bet the family has one already, will look up the maintanance records of the truck. the driver obviously was a driver, not the maintanance supervisor.

Driver should have signed an inspection form at the start of the shift.......that is what they will try to hang him with. Long time driver and he didn't catch it...........not that it's right but it's hung more drivers then you would believe.
