Myth or Fact?

I keep hearing my friends talking about how hiring a lawyer for a speeding ticket can get dismissed. they always told me that the lawyer can keep pushing the court date back and back until it just gets dismissed? anyone with positive input on this statement?

Any attorney who is guaranteeing a result is lying. Defense attorneys can't automagically dismisses cases. They can find issues and exploit them, or negotiate with the prosecutor. But the attorney in the room that has the power to dismiss is the prosecutor.

Frankly though, prosecutors and judges respect represented clients more.

Had a client on a drug case out in a not-to-be-named county who didn't qualify for an appointed attorney and didn't want to hire her own either. They kept resetting her for two week intervals at a time. When I got involved, the prosecutors had not even looked at the file since she was unrepresented (unrepresented people can't put up much of a fight so why bother taking the time to learn the facts). The norm in this county is to reset for 2-3 month intervals. They were just jerking her around. She probably had at least 6 court appearances by the time I came in where nothing happened and she was just wasting her time.

I have had this experience in Houston.

Had an HPD give me a ticket, went with a lawyer, date resetted for 6 months, then got dismissed.

It might only work at Harris county because of how busy they are...

I got a ticket last night for speeding.. Tell me why i got another one 3 min later! From another cop wtf. Broke a world record. Time between tickets are literally 15 min apart. Court will be in lubbuck court house.. Its usually busy when i visit

i have no idea... i pulled off back onto 45 and was lookin for the speed limit sign.. i was going about 70.. expecting the speed limit to be 65. then these 2 cops pulled up along me pointing their lights at me.. blinding me to pull over. i told him i just received a citation a half mile back! cops were also being dicks. he told me to not get to close to him when i was right beside my bike and he's the one who walked up towards me.

You can fight the second one, plead not guilty, tell the prosecuter you were coming off of the shoulder after being pulled over. You needed to gain speed to merge with traffic.

He will prolly toss it, depending hot far past the limit you were going.

Also, if I understand correctly they have to prove you were speeding if you were merging from the shoulder, they had to have been clocking you. I do not think they can pace you if you are trying to merge into the main lanes.

Dunno honestly, but I'd fight it.

if all else fails, ask the prosecutor for deferred. depending on your priors, youll most likely get it. just gotta be good for 6mos to a year then its dismissed i believe. someone clarify please? been a while since i got a speeding ticket. works for registration inspection and insurance tho

Check with attorney David Sprecher (offices on Montrose). He's gotten several of my tickets dismissed over the years. Another tactic is to try and get deferred adjudication for the ticket. Generally that means you pay a slightly lesser fine but it doesn't hit your driving record/insurance.

this case go urself or get a lawyer make him work and go get it reset usually they'll reset it a yr. from now by that time u would have cleared it and be eligible for another deferred.. if you get more tickets just keeep doin the samething

if u get defered in one county..u can sometimes get away with it in multiple countys..that is hoping you didnt get these two tickets in that same county you already have deferred did u?

Um... I was going to answer your initial question by telling you to get an atty. At the very least he may be able to lessen your fine. But, , son. Slow the down on the freeway.

My sis and I both got speeding tickets; used the same atty- both were dismissed. I think it cost about $100. We had to sit in the court house all day, but they were dismissed after lunch.

Oh, and did I mention that you should slow the down? You deserve all those tickets - you're obviously not learning a lesson just yet.
