I think what wackjum meant was the light is functioning normally except that it is not sensing the bike. The light is working, the sensor is not.
The law says if the light is not working you should treat it as a stop sign.

FYI Wackjum is a lawyer and doesn't post unless he is sure what he is saying.

The only time a signal light can be treated as a stop sign is when it malfunctions, and malfunctions are very clearly defined:

Texas Transportation Code Section 544.007. Traffic-Control Signals In General

[. . .]

(i) An operator of a vehicle facing a traffic-control signal that does not display an indication in any of the signal heads shall stop as provided by Section 544.010 as if the intersection had a stop sign.

Just posting to second the suggestion to call 311 whenever a light does not work properly. I did this for the ones along my regular routes, and after a few months, they all worked.

I also do as PPs have done... right turn, then U-ee, but as a woman rider, especially if it's at night, I will often just take the darn turn. If I get stopped, I will explain what happened and add that I did not feel safe hanging out at the intersection. I have been on an HPD ridealong and have also served on a community review panel for internal affairs, and the police I've spoken to say that yes, if you can explain why you did whatever they stopped you for, and it didn't endanger anyone else, and it makes sense, you'll probably be okay. It's just totally subjective.

A couple of times, when there was more traffic, and I had stupid cagers around me who couldn't understand my gestures for them to pull up closer or next to me to trip a sensor, I just hopped off the bike, walked over to the signal pole, and hit the appropriate walk signal.

I do not see how you will win the case. You ran a red light... You will have to show that there was no possible alternative path you could have taken, such us backing up and going straight through the light. Just because the traffic light did not sense you were there is no excuse.

Umm at the light it is a solid white line. He is not allowed to cross that line. B he also isnt allowed to back up. C he isnt allowed(white line asside) to cut in front of 1 or 2 lanes IE to his right to make a right turn. Common sense would say he has to run it. I personally wait for 2 full cycles and then safely gun the ... errr accelerate thru the light. I have been pulled over 2 times for this. Once they listened to me and he told me to call 311 LOL.. the next was a motorcycle cop who ended up talking to me for about 30 minutes about how much he hates that on his bike lol

Well, I'm back from court... and things did not go the way I wanted. Well, sorta. I was well prepared with:

1) a twelve minute video showing my bike at the traffic light and the red arrow not turning green for me once. I would post the video, but it is extremely dull.

2) a google maps printout illustrating that I had a clear line of sight and it was therefore safe for me to proceed through the light

3) a copy of the Texas Penal Code that states,

"Sec. 544.0075. CERTAIN TRAFFIC-ACTUATED ELECTRIC TRAFFIC-CONTROL
SIGNALS. (a) This section applies only to a traffic-actuated electric
traffic-control signal that consists of a traffic-control signal for
which the intervals vary according to the demands of vehicular traffic
as registered by a detector and that is installed and operating at an
intersection.

(b) In addition to any other type of vehicle the presence of which the
detector for the traffic-actuated electric traffic-control signal may
register, the detector for a traffic-actuated electric traffic-control
device to which this section applies must be capable of registering the
presence of a motorcycle
.

So I get there, wait until my name is called, walk up to the judge, and without looking at me the judge says "I'm going to dismiss your case. Go sit over there". Well ! Fuggin officer didn't show. I was really hoping to present my case, but oh well.

So, lesson learned: nothing. I learned nothing from this. Except maybe to check my rearview mirrors before I run a red light. Which I usually do, but... eh, oh well.

True, true. There is no way I could guarantee a win, but I was pretty confident that I would.

If I ever get another ticket for this, I'm going to tell the officer (politely) to only give me a ticket if he plans on showing up to court.

Oh, and I can't seem to get that kickstand trick thing to work. I still just run the thing. And I have called 311 about it, but the still ain't fixed.

Anyone here ever heard of the green light switch? Have had one on my bike since I bought it and I know there has been discussion about magnets I'm just surprised no one has mentioned the name of a company that actually makes a magnet for motorcycles to give you a green light Mine works pretty well, though I do have one stop light in my 20 mile commute that tends to give me probs, I usually jesture the vehicle behind me to pull up and they comply, if I had a cop behind me I would get in the middle without leaving the left lane and have them pull all the way up but I haven't had to do that. Congrats on the dismissal!

in light traffic if i am trying to go left at a red light, i will usually just go straight at the light and then bust a u-turn and take my road on the right when i get back to the intersection.
i have not personally seen one of those magical red light magnets in action, but it isnt much money to buy one.
i say talk to the judge. try and fight it.

i love it when judges dismiss .
i witnessed a female inmate cuss out the judge for something she even said she had done and the judge kicked her out of the courtroom and dismissed her case, because he didnt want to see her back in his court.

No, I've never heard of it. I think I may look into it. If its relatively cheap, then it will definitely be worth it.

lol, yeah. Actually the judge was kind of a to a lot of people. This one dude had gotten a ticket for no insurance and wanted an extension because he didn't have any money to pay it. The judge basically bitched him out and then dismissed his case for being poor! But yeah, a win is a win
