yeah lol, when i worked for puffer i called OSHA once because they wanted me to disassemble a valve full of benzine but didn't want to give me a mask because they didn't have time to go get one...not happenin

I have not seem an employer yet that wouldn't put all the wood to ya possible. They punk ya if ya let them. You act as your own agent. They will pay you as little as you will take. Don't think they don't evaluate the situation. I have a friend like that. He is in the same position with the same company. He makes 3.50/hr less than I do. He takes what they give him and doesn't ask for more. I thinks its due to his upbringing as a 1st gen.

you're right about that. i'm just taking advantage of being able to use some bad gear, and getting practice in so i can build up a little freelance work, at which point i will tell them if they want their cars shot, they can pay me per car and i can get it all done in one day.

and bluewave i think you're right about upbringing. i was taught to work hard and be happy with what i'm given, but there's got to be a point where enough is enough, and if i'm putting in 60 hours a week i should not be struggling financially, especially considering i don't even go out anymore

Sec. 61.019. FAILURE TO PAY WAGES; CRIMINAL PENALTY. (a) An employer commits an offense if:

(1) at the time of hiring an employee, the employer intends to avoid payment of wages owed to the employee; and

(2) the employer fails after demand to pay those wages.

(b) An employer commits an offense if the employer:

(1) intends to avoid payment of wages owed to an employee;

(2) intends to continue to employ the employee; and

(3) fails after demand to pay those wages.

(c) An employer commits a separate offense under Subsection (b) for each pay period during which the employee earns wages that the employer fails to pay.

(d) An offense under this section is a felony of the third degree.

Someone said dealership....

Do you work at a car dealership for flat rate?

If so there is nothing to be done.

It has something to do with some arcaine law from the 20's that involves
transportation employees.

OT only applies if you are paid hourly on the clock.

it is a dealership. but i'm also hourly, on the clock. i'd rather not go the attourney route because although he could get my backpay, he can't get me a new job.

you can demand all back pay and future pay.

they cant fire you for enforcing the law.


They can find a reason to lay you off after the fact, or fire you.


I understand your position, but any decent employer will pay yr OT and keep paying it.


Employers always make mistakes in their favor, just mentioning it may solve the problem. They will try and get away with it if they can, but the minute you call them out, they know they have to follow the law.

that's what i'm hoping for. i think i'm gonna try to chat with him politely and let him know that i want to continue working there, but i'm financially strapped and getting my O/T would make the job worth it. i suppose if he says no, i'll just go back to work and quitely seek employment elsewhere, while preparing paystubs for an attourney to get backpay. hopefuly he will give in, there are a lot of perks here i don't wanna lose

aer 40hrs a week is considered ot and should be pay 1 1/2 the amount of reg pay, if you keep ur check stubs were it says were getting paid 60 hrs a week straight time u can easily win the situation and be paid w no q asked if u have prove.. just safe ur check stubs, wiat the day he lays u off and hand them over to him and he amount of hrs he ows u in ot!!!
