how to tell your boss to give you O/T?

i'm trying to figure out the best way to tell my boss he needs to pay me O/T. i work 60hrs a week and don't get any O/T. i wasn't aware untill recently that's against the law. I just don't want him to say, ok, go get paid O/T somewhere else because i can't afford to go looking for another job. then again i'm strapped as it is, and getting my overtime pay would certainly help. any suggestions?

Just call OSHA and let them deal with telling him it's gonna be hard for him to pull rank with them

what do you do? and I assume you are hourly? If you're salary, you're probably SOL.

osha has nothing to do with pay and overtime.

Labor board would be the call to make
DEPT OF LABOR.....

An employer who requires or permits an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA) must receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, unless overtime hours are worked on such days.

The FLSA, with some exceptions, requires bonus payments to be included as part of an employee's regular rate of pay in computing overtime.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

Danny is correct as well. Hourly or Salary????

well, his wife is hot...but she won't pay my bills lol. i'm hourly. i'm the photographer for his dealership. i've been told some dealerships have exceptions but only for contractors, but i'm not a contractor. since i started in april i've never had a week under 50 hours. now they have been good to me as far as, if i need a piece of gear to get the shots the right way, they'll buy it, etc. and i've never been one to make waves, but i should get whats due

Tell him your going to need 1.5X for future weeks over 40. If he and fires you tell him your going to the labor board and seek past OT pay.

If you don't have records. Try to get them from the dealer before you bring this up. Tell them a BS home loan story if ya need a reason. They may try to misplace them after you ask.

that's a good idea, that way if it goes south at least i have a little money to look forward to

i've never been good at confronting employers about money, i just keep my head down and get my job done, but i'm starting to learn hard work alone won't get me anywhere, except taken advantage of

Well are you salary or hourly? If you're salary then I'd recommend you getting another job you're more satisfied with.
