Yep happens all the time, but most dont understand that it is still on your record and will not come off till you expunge it.

As for DA or not, as far as I am concerned if you plead out like that you are GUILTY.

i agree, if you are not guilty then you'd be fighting it a lot more and not accept anything but no sentence

That is how I am, no matter what the time I am looking at. I will take it all the way, if I didnt have anything to do with it and I know I am not guilty. If you find me guilty then I live with it, but I am going to make you work for it and plead my case all the way to trial.

True, but I did read the post by the defendant on this website. I will say this it sounded good, and really was pulling for him. But if someone came to drop a bike off at your house, they called you. The bike would have there prints on it, and somehow would have proved the bike was given to me by said person/persons. It was not just one bike either, but I sure would have a way to prove it came from the person that dropped it off, they would have had to touch it at some point. I would have paid out the A$$ to keep from pleading to a felony. As now no matter what, he will have getting a job, and that alone is worth loosing it all to prove my innocents.

I took DA on a case I couldn't afford to fight. Had I had about 15g's I would have easily beat the charge. I had no choice at the time. I'm saying you guys talk a bunch of like you have some experience with it. I do have real experience of how the law really works and how charges are handed out. You think the cops must be right and he must be guilty. Y'all need to wake up. It's guilty until you can afford to prove your innocence.

best thing is not to get caught doing things like this...then we wouldnt have a thread full of senseless people who have no law degree nor knowledge of how wayward the judicial system is

this is how the system works...they want money and convictions.

if I had bluewaves contact info and address. I could make up any seemingly good story and call the police. If they deem any of my story liable to a jailable offense..
Bluewave would be arrested.

and lets just say, He lost his job and has no money or resources. Well he would be issued a court appointed lawyer who just finished law school and need to build their portfolio lol,who doesnt have ur best interest at hand. That court appointed lawyer will offer 3 years DA the first chance he gets unless you can come up with mooolaaa

He may or may not be guilty. Just because he plead out doesn't make him guilty (although those were some peculiar circumstances). Deferred adjudication is similar to torture in the medieval days. The whole point of torture was to get a confession and everyone would confess just to make it stop. DA and reduced time for guilty pleas is the same. You either confess, take a little probation or reduced sentence, or face many years in the animal house. It works and that is why it is offered to a lot of people. Most people take it even if they are innocent. Because the alternative, just like continued torture, is a nightmare. I've taken it and it wasn't that big of a deal. I had a friend who got offered 2.5 years for a guilty plea, but he was innocent so he took it to trial. "There is no way they can prove me to be guilty because I am innocent," is what he said. Two months later he received a guilty verdict and the judge gave him 15 years.
