Lane Splitting

I know there is another post about this right now but I want to ask again.

IS LANE SPLITTING ILLEGAL or NOT.

No grey area bs.

It either is or isn't. I know a cop can say anything but can he by the law give you a take that says " offense: lane splitting". even if your doing the speed limit.

It is NOT legal...

& even if it was, Its still a bad idea.

From Wiki...

"Lane splitting is riding a bicycle or motorcycle between lanes in the same direction as traffic. It is also sometimes called lane sharing, whitelining,[1] filtering, or stripe-riding.[2] Lane splitting usually refers to moving at a greater speed than traffic, in response to a traffic slowdown,[3][4] a form of filtering forward.
Lane splitting by motorcycles is generally legal in Europe, and in Japan and several other countries, and is illegal in many states in the US, but is considered lawful in California (see list below).
The legal restrictions on lane splitting for bicyclists can be the same, such as in California[5]. In some jurisdictions, such as Nebraska, lane-splitting is prohibited specifically, and only, for motorcyclists [6]"

from what i have heard it is NOT legal.
when you look at the state laws TX does not specifically address it, but instead states it in other areas saying that no two vehicles should occupy the same space in a lane.
i think its technically not legal to even ride side by side in the same lane with another motorcyclist.

in cali im pretty sure the rules are that you can lane split when speeds are 25 mph or below and you can only have like a 5mph difference in speed between you and the cars you pass. this is more for stop and go traffic.

im not a lawyer so dont hold me to this tho

driving between two cars on the dotted line on the freeway, highway or street. (note: wouldnt recommend drivine on the little bumps but you get the idea.)

Its legal in california because of all the bad traffic. Bikers can leagally scaddle on through lane splitting and dont have to wait for traffic will its stopped.

18. Can I ride my motorcycle between cars in traffic?
The law doesn't specifically say one way or the other, but there are several statutes that may come to bear depending upon the circumstances, i.e. right of way, obligation to drive in a single lane, signal intention, passing with safety, etc. Motorcycles are considered equally as cars regarding traffic laws, so the single lane, signal intention and other statutes in the Transportation Code could come in to play.

The main statute that makes "lane splitting" illegal is Transportation Code Section 545.060, entitled "Driving on Roadway Laned for Traffic."

An operator on a roadway divided into two or more clearly marked lanes for traffic:
shall drive as nearly practical entirely within a single lane; and
may not move from the lane unless that movement can be made safely.
Texas Transportation Code

So the answer is .... do what you want but be prepared to convince a jury or judge that it's legal.

so its ok to ride the emergency lane(i hope that means the shoulder)?

i ride it when traffic is stopped and my bike is at 220* but i always assumed it was illegal and i'll get in trouble if seen by a cop.

that i really need to know because not only does it save some time it also saves from dehydrating into a saltine cracker while sitting in houston rush hour traffic
