Catherine Stone, Texas Appeals Court, in the 2008 case of Aaron C. Aguilar v. Texas, emphasized that a person, including law enforcement, does have the capability to differentiate what is excessive or unusual noise emanating from a motor vehicle hence, TTC 547.604 and its sister ordinance COH 30-3 are not "void for vagueness," or subjective.
You're doing an excellent job at proving the opposing side's point. I'm relatively certain that Holtsclaw's ears are in no way calibrated to detect sound pressure levels accurately. Therefore, he's using his subjective judgment to determine what's illegal, rather than obtaining the necessary evidence.

you sir are a idiot, a BUFFOON at best. 200 complaints does not mean he gave 200 tickets.

if there has ever been someone who has repetitively proved their stupidity without restraint and insisted on being functionally retarded to a community, you sir, are it.

I wanna know why some of you think that it is funny to mock others who are willing to stand up for what they feel is right. Right or wrong, the fact that we can and and do protest what we think is BS in this country is an honorable thing. Or maybe we should all just STFU and do exactly what we are told :insert sarcasm here:.

Actually the news article states that Holstclaw wrote 200 noise tickets in 9 months.

Dvl may be an idiot, but it would appear his reading comprehension is up to par.

I have read somewhere though that due to the whining about the matter of subjectivity, the officer in question has made a request to include the SAE J2825 stationary motorcycle test as part of his traffic stop routine thereby providing the objective standard we are asking for. I read on the petition site that the officer actually has a sound meter in his car and has knowledge of the J2825 procedure but is not permitted to use it at this time.

Caution though, there are some jurisdictions that use the J2825 test and issue a citation for failing the idle test and the RPM test...so they issue two citations for the same offense. I don't think Houston would allow that but who knows.
I have a strong suspicion that we have an enemy among us. I am betting this is the very cop we are discussing.

I heard HPD on some sort of escort recently and their HD FLH's were loud and obnoxious, definitely not OEM. One had Rineharts and I think I saw one with Vances and fishtails.

Seems as if the boys in blue have refused to adhere to the Mayor's mandate...and those who escort this unruly group to city hall, considering the fact they are escorting illegally loud motor vehicles, stand to be filed on in IAD for participating in a behavior that embarrasses and sheds a bad light on the PD. Just a thought.

I think he just removed all doubt. I believe this to be the cop. There is a reason this cop is still on the street writing tickets. He should see his rank as a reminder of his failures.

and if he is? <shrug> He pretty much has the same right as us to post here and he's no acting much more
an that most the rest of us have.

Presuming 'he' is.. <shrug> Busa, what are your personal thoughts in regards to the...proposed change/decibel
check. Would you, as a LEO/presuming you are/may be one.. have any problems holding to those proposed 'standards'?

Does anyone else have a problem/issue with those proposed standards?
