Been reading this thread for awhile now. Some Key notes I see:

1) DVL doesnt sound likes hes defending this cop, but seems more like he's arguing just to feed the rise he's gettin out of everyone.

2) Rachy seems a little embittered for gettin corrected on her post about what chips referenced.

3) Chips and honorsdaddy sound like they have a fair argument, how immoral or how unethical some might view it as

Nope not at all. I was going off of what was public not was is kept a secret. I was incorrect because of the information I had.

I certainly haven't read all the thread, which is way too long, but I wonder if all this talk is actually going to amount to something or is just a session. BTW, most of the police I have encountered have been ok or cool, but I hate the ones on a power trip.

Most of the Police are really cool and there are just a few with a power trip like this one. As far as this being a session, yeah I guess it is. What are forums for except to express opinions and gain incite from other people. You can't fight the law in a forum, but you can learn things from other peoples experiences, and hopefully have a better chance of not having to go though the same thing.

Believe me I am taking this to court and will fight it the right and legal way.

The only reason I corrected Rach on the code section number was to show that the correct number was referenced by the part of the code that requires a decible reading. The section she noted was not.

try not to look at it that way. no cop can learn EVERY law and it's details. they will learn a little about a lot of laws. and too boot, cops are human too, they make mistakes and chit happens. that is why lawyers have legal aids. they look up past court cases and cite president to keep on the level. if one chooses not to use a lawyer, they are most likely doing themselves a disservice.

Granted, no cop can no EVERY law, BUT he should at least be able to articulate probable cause.

With what Holtsclaw is doing, he knows well every bike he pulls over is 100% legal, and the owner is doing nothing wrong - but he does it anyway.

No different than if he stopped people for going through a green light at the speed limit and claiming he stopped them because in his opinion they were going too fast for the conditions, or should have stopped at the green, looked both ways, and then proceeded at a snail's pace.
