Cliffs notes:

cop terrorizes motorcyclists on west side for loud pipes.
Appears to be on a crusade to end noisy bikes for good.
Recent update: Honorsdaddy was arrested...

Yeah - i got to spend Saturday night as a guest of the City of Houston because I told Officer Dredd, er, Holtsclaw that my pipes are 100% legal and I'd like to know how he determined they were illegal. At that point - i was told to place my hands on the car and told I was being arrested for .....illegal pipes.... Upon reminding him that equipment violations are not an arrestable offense, the charge was changed to - get this - "resisting arrest". When I reminded him it was perfectly legal to question, and if necessary, resist an illegal arrest, it was changed - once again - to "Interfering with the duties of a public servant".

Oh yeah - was also told that "people like me need to learn that we are not in charge around here..." I guess questioning his authority is something he takes serious offense at.

Hey honorsdaddy I think since u part of a MC u need to get with Coc all of mh and maybe hpc all ride through there. Wish we could make this a call to action for the defenders. I think enough of us roll into that area on bikes they might change there minds a lil. Bad think is talking to my uncle about this he told me that as long as u pass state inspection they have nothing to stand on. Its sounds to him he and that part of town has made it out to be the way they wish the law was meant to b written. My uncle is a motorcycleguru and Galveston county judge. He more than willing to ride his bike to do this.

But NOT every aftermarket pipe is marked such, and not all of them are that loud. Even if they were, Texas does not have such a requirement, and attempting to misuse statutes to force such a requirement in direct disregard for state law is wrong.

Texas has no requirement? I thought the law said something about if a vehicle came with a cat/muffler it was then illegal to remove them? There is no noise restriction at all, EPA restriction? In NJ they had decibal readers at the entrance of highways that would alert police if you broke the limit.

Yes and no. In this particular case, the city cannot arbitrarily decide that equipment that meets the state requirement for safety and/or emissions is illegal based on an arbitrary and subjective standard.

Texas has NO emissions requirements for motorcycles and EPA standards vary from year to year.

The statute being applied is as follows: The use of any motor vehicle so out of repair, so loaded, or so noisy that it creates any loud and unreasonable grating, grinding, rattling, or any other loud and unreasonable sound is hereby prohibited and declared to be unlawful.

Note that the vehicle has to be "so out of repair" or "So loaded" or "so noisy" that it creates a loud and UNREASONABLE sound.

It is not unreasonable to expect to hear some vehicle noise at one of the busiest intersections in Harris County on a Saturday afternoon....

Texas has no emissions requirements for bikes. Mine never HAD a cat. It does have a muffler.

ok....wouldn't it be smart to take the ticket THEN go to court and run your mouth?? Cops win...thats just the way it goes. Take your ticket and STFU...or as you found out....go to jail!!

AND...its my understanding that cops don't HAVE to write a ticket...you can be taken to jail for ANY law violation.

I wont go into details except to say there was not even the option to take the ticket.

Maybe YOU believe "cops win" but for some of us, well...we dont just bow to the badge.

When a cop abuses his authority, and his superiors show no signs of curtailing him, well....someone has to fight it.

This is not "legally true". You can only be arrested for offenses which allow the penalty of arrest. You cannot be "legally" arrested for ANY violation of the law. This sheeple thought process is one of the reasons for a failing government. Everyone just gives in and follows, no matter the consequences and loss in rights and liberties.

Don't get me wrong....I've personally met crooked/bad cops...had quite a few run ins with them through my younger years...and they DO win...you went to jail...you lost. Going to court and making a big fuss will just make things worse for you if you ask me, just keep from around him. It's not fair..but it is what it is bro!

Yep - and "illegal pipes" is not even CLOSE to an arrestable offense - in fact, its not even an existing offense.
