Yeah - i got to spend Saturday night as a guest of the City of Houston because I told Officer Dredd, er, Holtsclaw that my pipes are 100% legal and I'd like to know how he determined they were illegal. At that point - i was told to place my hands on the car and told I was being arrested for .....illegal pipes.... Upon reminding him that equipment violations are not an arrestable offense, the charge was changed to - get this - "resisting arrest". When I reminded him it was perfectly legal to question, and if necessary, resist an illegal arrest, it was changed - once again - to "Interfering with the duties of a public servant".

Oh yeah - was also told that "people like me need to learn that we are not in charge around here..." I guess questioning his authority is something he takes serious offense at.
i would certainly hope that after you win your case that you file a lawsuit against him and HPD for false arrest.

What would this douche bag be if he wasnt a cop? He needs to be investigated. I wonder how many others have been guests of the grey bar motel for aftermarket pipes.

This guy is on a serious power trip, and obviously needs to be knocked downa few pegs. I cant believe he took you to jail for asking for something completly within your rights as a citizen. He must have a tiny , a tinier brain, and a severe little man syndrome. Illegal pipes, give me a break. Theres no doubt in my mind he has seen this thread, and could be part of the reason he is still pursuing this Holy Grail of stupidity.

you Officer Holtsclaw!!

His number should be plastered all over CL. Someone set up a glory hole location with his number as a contact. How about a 2007 GSXR 1k with loud pipes for 2500.00? He will at least need new cards after the number change.

Geez, I been reading this thread and almost forgot to say...

FTP!

Maybe the way to deal with this would be to get a small group that includes a couple of bikes with loud pipes, the others with stock.
If/when he stops them the guys with stock pipes could video what happens to the guys with loud pipes. Even a car following could vid.

Dude does have a serious hardon for noise

Quote:
Message date Wednesday, April 14, 2010

Those of you familiar with my ongoing battle with a particular supervisor regarding the validity of Houston's City Ordnance 30-4 "Noisy Vehicles Generally" will be pleased to hear that City Legal has returned a verdict of "enforceable.Ē I was subsequently called into my Captains office and told that I was permitted to resume enforcing the noise ordinance as it relates to loud exhaust on motorcycles and automobiles. The earlier order to stop enforcement due to perceived subjectivity issues has been overturned. Those members who have an abiding faith in our Lord Jesus Christ pray that I will enforce the current noise ordinance with wisdom and discernment. Thanks to those who took the time to write the letters and make the phone calls.

Sincerely,

Rick Holtsclaw />
Houston Police Department

Westside Division
I'm sure it's been posted before but for those of us just tuning in on page 31 there are a ton of google hits for this dude.

Apparently back in 1986 he also got his spanked by the 5th Circuit Court because he believed he could arrest people for interrupting him. The 5th Circuit explained in quite clear language that he could not.

Now granted, this was 1986, but how often does someone need to get smacked down before they realize they are overstepping their authority?
