cuz popping wheelies has nothing to do w/ it...........it's manufactured badly. suzuki might not be so dumb either. they have alot more resources to prove you "abused" the bike vs "it just broke".

let alone the $ to fight that battle.

Well, I am glad to see that this thread blew up!! It was 2 pages when I last posted! lol

Its a touchy subject. Glad this stuff can be discussed on a forum like this. Every one has a different point of view, and has something to bring to the table, so to speak. I would hope that everyone takes a little of this discussion and remembers this next time they throw a leg over the old bike.
We all want to be able to enjoythe bikes and too bad there are a few that would spoil the fun for everyone. If you or your bike isnt legal, then get legal. Its that simple.

I agree that the Texas Transportation Code does give officers of the state the authority to do this under 521.025, however Texas law is trumped by the U.S. Constitution, specifically the 4th, 5th, and 9th ammendments which protect against unlawful search and seizure, give us the right to not be forced to give testimony against oursleves, and give us the right of privacy. Case law (See Brown v. Texas 99 S.Ct. 2637 (1979)) has rendered 521.025 impotent.

As absolutley disgusting as it is, the U.S. Supreme Court (in Michigan State Department of Police v. Sitz (1990)) has held that checkpoints whereby vehicles are stopped at random may be established for the purpose of stopping drunk drivers, but even there the restictions on how these are handled are very tight.

Bottom line - the D.A.'s office and the City of Houston attorney agree that stopping a vehicle for no reason other than to check for a driver's license is illegal and a violation of the person's civil rights and that an officer who does stop a vehicle for this reason is guilty of official oppression.

too bad all your facts are thrown out the window when prolly 80-90+% of the bikes have illegal aspects of their bike, and a given reason to be pulled over.......lol

Police no longer have to knock on your door when serving a warrant. They can just bust right in, scare the out of your family, and arrest you.
