thats bullshit thats how people get shot coming out of your car with a loaded weapon. obviosly this didnt happen in houston. but are the cameras illegal in tx??

I think the guy will get off on a technicality here.

what I want to know is, is there audio/video foootage of the MARKED troopers scene of the stop?

if so, then I cant see why/ how you can give one camera consent, but then use the other camera as a felony not knowing you are on film..when you know the marked trooper is potentially recording.

I bet a squad cars footage "magically disappears"...

NO! they are not illegal.

texas is a "one party" audio/video recording state.

as long as ONE of you knows you are being recorded you are OK

but if an outside source is recording you, and is NOT within grounds of conversation, then it is illegal.

I audiotaped, and videotaped my ex wife conversations each time I saw/spoke with her in person or on the phone. (and presented them to the courts)

as long as 1 of you knows OR....if you are in a public area that anyone can "over hear" in general as a public spot....completely LEGAL.

I don't think it there is a "technicality" here. The rider was illegally assaulted be a popo if you ask me.
I guess time and the courts will decide.
As far as the cameras are concerned, I would bet that the law allows police cars to video without prior consent. But that still doesn't make it right to charge the rider, since he had no opportunity to turn off the camera while he was being assaulted by the cop with a gun drawn.
He probably shouldn't have posted the vid on the net but it wasn't confiscated on the spot either. If the cops suspected an illegal vid was taken then they should have taken the cam.
I see an underlying problem with making it illegal to film cops anyway. How many times have we seen cops acting illegally because some bystander had a camera and caught the action?

An off duty LEO never should have been involved in pulling the bike over unless he had committed a felony and was a danger to the community.

ask Dave C about that...I think he got caught by an Off Duty popo one time poppin baby wheelies. Although guns and stuff weren't used I'm sure.

I think this one is over the top....that guy thinks he's Mr. Badass with his gun...he's lucky he didn't get shot.

search u-tube... the leo (out of uniform).. gets out of the car, pulls his gun..it's almost 6 seconds before the officer identifies himself as a LEO.

Whoa...I would have been ghost as soon as a car whips around the front of me and opens a door like that. Why did he pull his gun? A moment of fear...if people going in reverse at 1mph on a motorcycle creates enough fear that you have to pull out a gun then maybe you shouldn't be a police officer and maybe you should see a doctor before you kill some poor . If by moment of fear he meant that he thought he was gonna run then it would be better to have both hands to grab him off the bike especially if your only two feet from him. You can't just shoot the guy in the face for trying to take off.

To be honest I'd be in jail, some in an unmarked car and a hoody pulled up on me at that angle and pulled a gun he would have gotten stuffed into the corner of the door jam of his car with my bike and I would have proceeded to get off the bike and beat his for pullin a gun on me, the video would be the least of my problems.

If I'm understanding this correctly, the law states that you can't be "unknowingly" audio recorded. Therefore, I don't think the officer's car cam would violate this, because it's just generally understood that the camera will be rolling on the front of the car at all times.

Now, for this guy, I'm thinking he'll be able to get off by showing how absurdly obvious it is that there is a camera on the top of his head that the officer should have assumed would be on, like any other rational person would. And that's in addition to the fact that the video makes it clear the camera was on for a good period before the officer stopped him, and not with the intent of recording an officer. The officer didn't give him a chance to turn it off as he charged at him with a gun. AND he didn't make it clear that he was an officer right away. In fact, I wouldn't have believed him just because he said it either. better have a badge handy if you're gonna be running at people with a gun.

I hope he goes free and it costs the state a load of money.
