Should I go to court???

Bummer I got a ticket on the way home for lane splitting.
The charge on the ticket is FAILURE TO MAINTAIN LANE POSITION.
If this was straight up you boys would not be hearing about it but wait there is more...

This was in my fair town of FRIENDSWOOD with no love for motorcycles especially black dangerous whips such as my NINJA.

The cop who pulled me over did not see me split. He was going by a tip by a so called undercover female officer in a grey blazer.

Do I need a lawyer??
Should i just do the defensive driving??
or am I

If you can take dd then just do it. I got a ticket on the car when I couldnt do dd so I got a lawyer [take note I was pulled over by HPD so I pretty much knew I had a big chance that the cop wont show] and he didnt. Case dismissed.

Go to court.. Stay out of a warrant. If they wanna ***** about it, get the lawyer. This is a bs case. Shouldn't take much.

A buddy of mine from work got a ticket like that where one cop "supposedly" sees the offense (in his case, it was speeding) but then another cop gives you the ticket.

I dont remember if he either:

1) argued with the cop that pulled him over that "HE" did not catch him speeding so "HE" could not issue the ticket. He said something about asking the cop to show or prove the offense (radar or video)

-or-

2) it actually went to court and he used the above arguements to win his case. The cop admitted that he did not witness him speeding nor had used a radar gun or had any video image of him commiting the offense.



I dont remember which it was but he said he got it dismissed.

Other than that story to share, I have no valuable input. Sorry.

Take it to court. The undercover female officer would have to appear in court, otherwise anything she told the cop that gave you the ticket would be considered hearsay which should be disallowed as evidence by the judge. If the prosecution doesn't have a witness then the prosecution can't prove their case. The cop that gave you the ticket can't be considered a witness to your "violation" since he didn't see it.

The cop who pulled you over is not the cop your atty. will ask the prosecutor for. the person who saw you will be requested by your atty. the D.A. will wash their hands of this. Call my atty. Paul Kubosh 713-222-0990 oh! and stop the lane splitting before a driver decides to throw his door open and make you do a face plant in front of everyone then the rest will jump out like wild monkeys after a fresh kill. Happened to a friend of mine. Have to tell you about that after you buy me a beer for getting out of this ticket. LOL......
