Minivan has no blinker on... but rider makes bad pass... who's at fault?

one thing its not a minivan its a lexus rx300 and if it were florida it would be a no fault seeing as they were both in the wrong... here in texas bikers fault and stupidity... hope he got owned

let me see, according to the DPS book on the test I took, you must be at least 2 seconds behind the vehicle ahead of you and observe ahead. Then react which was to slow down by shifting to 1st and covering the front and back brake. , that was not the case here!!!
