Hope you got the witnesses contact info too, because I think you might have a hard time proving it was them that dropped the mattress.

Glad to hear things are coming along though.

Check if the frame is eligable for the cracking recall. Might be able to get a new one.

Glad your buddy is ok, too bad about the bike. Did your buddy hit the truck the that dropped the mattress at all? If not there is nothing the cops can do about it the vehicle was not involved in the accident, therefore can't be prosecuted for failure to stop and give information. It's the same situation as a rock, or other road debris, being kicked up by a car in front of you and cracking your windshield. It sucks I know.

The recall was on the 1000s, not the 600s.

At the very least they could be ticketed for littering.

I'm fairly certain that failure to secure load is a traffic offense in texas and that an improperly secured load that is lost and results in an accident will make that party at-fault in the accident.

I remember a case where a truck in Baytown towing a large BBQ pit lost their BBQ pit trailer. The trailer slid across the road into oncoming traffic where it struck a ar killing the driver. The truck driver who lost their load was found to be at-fault.

Let me ask around and see what people say, I'll report back.
